There are several outstanding issues that you should address at the subdivision to comply with Commission orders: 1. The downgradient sides of many of the detention pond dams appear to be steeper than required by your permits and steeper than is needed to insure long term stability of the dams. The final dam side slopes should be build and stabilized this fall. 2 . Your consultant should review the Southview Acres Orders of Conditions and the accompanying plans and determine what work still needs to be done. Once all work is done they should file a certification that all work has been completed, using a checklist of all the required work, and request a certificate of compliance. 3 . A Notice of Intent must be filed before most of the remaining lots can be developed, in accordance with the previously issued Enforcement Order (EO) . The Commission expects you to comply with the EO and to file a Notice of Intent before beginning work on ny of the lots covered in the EO. They will take enforcement action if any work occurs on any of the lots covered by the EO or if any of the soil on any of the lots covered in the EO become de-stabilized for any reason. The Commission is not currently planning to take enforcement action for not filing a Notice by June 30, 1990, because the area is currently somewhat stable, but they reserve the right to take action in the future. Your attorney, Jonathan Souweine, suggested (July 31, 1990 letter) that present your case to the City Solicitor so that she can advice the Commission as to their options and the strength of your case. We appreciate this effort and will request that the City Solicitor review any written submittal which is sent to the Solicitor and the Commission for our collective review.
