Re: Permitted Use Opinion
Dear Mr. Patillo:
This office represents a client who engages in the business of automotive upholstery, including the
replacement and repair of convertible tops. The business does not engage in any other automotive
repair, body work, oil changes or engine work, nor does any of the work performed by my client
require the use of motor oil. My client is seeking to establish a business in the City of
Northampton, on certain premises currently zoned as a Central Business Zone. I have reviewed the
City of Northampton's table of use regulations and do not find that my client's proposed activities
fit squarely within the list of designated commercial uses. It would appear that my client's services
are somewhat of a hybrid of (a)personal and consumer services establishment; (b)business service
and supply service establishment; and (c) repair service establishment, all of which are allowed by
right within the Central Business Zone. My reading of the City of Northampton's Zoning
Ordinance leads me to conclude that my client's activities do not fall within the definition of an
automotive repair or automotive service station which is not allowed in a Central Business Zone.
However, as I am sure you can appreciate, my client wishes to confirm that his proposed activities
are currently allowable by right within a Central Business Zone prior to acquiring title to the
property or entering into a lease relative to the use of the property.
In that regard, I hereby request, on behalf of my client, an opinion from you relative to the
foregoing.
