application met each one, where applicable.
Board members also indicated they agreed that the application met
the criteria for granting a Special Permit.

April 3 , 1996
The Zoning Board of Appeals met on Wednesday, April 3 , 1996 at
7 :00 p.m. in the Council Chambers, Wallace J. Puchalski Municipal
Building, 212 Main Street, Northampton.
Present Were Members: Chair M. Sanford Weil, Jr. , Alex Ghiselin,
and Associate Member Larry Snyder.
Staff: Senior Planner Paulette Kuzdeba and Board Secretary Laura
Krutzler.
At 7 : 47 p.m. , Weil opened a Public Hearing on a request from
Daniel and Christine Gobillot for a Special Permit to attach an
accessory building to the principal structure under Sections 5. 2 ,
` 6.7, and 10. 10 of the Northampton Zoning Ordinance, for property
located at al Winterberry Lane, and known as Assessor's Map #36,
Parcel #221.
Daniel and Christine Gobillot presented their application.
Christine distributed pictures of the property.
i The Department of Public Works had no concerns about the
application, Weil noted.
The couple is proposing to extend two feet of roof so � ey do not
have to walk through rain and snow [between their house and the
art studio] , Daniel said. The connecting structure wi 1 be an
open breezeway. The distance between the two buildings is two
feet at the closest point. The porch of the principal st;ucture
will be continued to be attached to the other building.
The accessory structure is allowed under zoning. However, once
the art studio is connected to the house, it becomes part of the
primary structure. This requires a Special Permit because the
rear setback will be reduced to twenty-five feet rather than the
forty required by zoning, Kuzdeba explained.
Kuzdeba noted that building separation requirements have been
changed since a building permit was issued for the art studio.
New zoning regulations now in effect require at least a five foot

Pursuant to Massachusetts General Laws (MGL) , Chapter 40A,
Section 11, no Special Permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed, or if such an appeal
has been filed that it has been dismissed or denied, is recorded
in the Hampshire County registry of Deeds or Land Court, as
applicable and indexed under the name of the owner of record or
is recorded and noted on the owner's certificate of title. The
fee for such recording or registering shall be paid by the owner
or applicant. It is the owner or applicant's responsibility to
pick up the certified decision from the City Clerk and record it
at the Registry of Deeds.
The Northampton Zoning Board of Appeals hereby certifies that a
special Permit has been Granted and that copies of this decision
and all plans referred to in it have been filed with the Planning
Board and the City Clerk.
Pursuant to Massachusetts General Laws, Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the
Northampton City Clerk on the date below.
If anyone wishes to appeal this action, an appeal must be filed
pursuant to MGL Chapter 40A, Section 17, with the Hampshire
County Superior Court and notice of said appeal filed with the
City Clerk within twenty days (20) of the date of that this
decision was filed with the City Clerk.

Section 6.7 Accessory Structures
I
In all districts, an accessory structure attached to the
principal building shall be considered as an integral part
thereof and shall be subject to front, side and rear yard
requirements applicable to the principal building, except that
the Special Permit Granting Authority, which shall be the
Planning Board if another Permit is requested from the Planning
Board and shall otherwise be the Zoning Board of Appeals, may
grant a Special Permit to allow a new or existing accessory
structure to be connected to the principal residential structure
in a residential district provided the following conditions are
met:
1. The side and rear yard setbacks are at least ten feet
(10' ) .
2 . The accessory structure is used only as a workshop, and
not for any other uses.
3 . The structure is no more visually intrusive than a
detached structure in the same location.
In reviewing the application for a Special Permit, the Zoning
Board of Appeals found that these conditions have been met.
C. The requested use will promote a harmonious relationship of
structures and open spaces to the natural landscape,
existing buildings and other community assets in the area
because it will not change the existing relationship.
D. The requested use will have no effect on the City's
resources, including the City's water supply and
distribution system, sanitary and storm sewage collection
and treatment systems, fire protection, streets and schools.
E. The requested use meets any special regulations set forth in
the Zoning Ordinance, particularly Section 6. 7 Accessory
Structures. (See Attachment A)
F. The requested use bears a positive relationship to the
public convenience or welfare because it will enhance the
value of the owner's property.
The use will not unduly impair the integrity or character of
the district or adjoining zones because the breezeway is in
keeping with the. residential use of the zoning district.
The use will not be detrimental to the health, morals, or
general welfare, and the use shall be in harmony with the
general purpose and intent of the Ordinance.
G. The requested use will promote City planning objectives to
the extent possible and will not adversely affect those
objectives, as defined in City master or study plans adopted
under M.G.L. Chapter 41, Section 81-C and D.
