RESOLUTION
WHEREAS, the City of Northampton acquired an 2.16±acre parcel of land off Burts Pit Road
which it no longer needs for municipal purposes; and
WHEREAS, the Conservation Commission has analyzed the property and determined that it
would not be a good conservation area because of its size,resources, and lack of
public access; and
WHEREAS, the Conservation Commission has determined that the site is not suitable for
housing or other development because of wetlands and water resources and
recommends that the site should be preserved by the City holding a conservation
restriction; and
WHEREAS, the Office of Planning and Development assessed the site for suitability for
housing or other development and found the site could not be developed without
damaging wetlands resources
NOW,THEREFORE BE IT RESOLVED,
The City Council hereby declares the property surplus to city needs-and
authorizes the City to execute a purchase and sale agreement and deed or
deeds to sell this site in accordance with state procurement requirements;
and;
The City Council directs that the sale be subject to the City,acting through
its Conservation Commission, retaining a Conservation Restriction on the
site, authorizes the Conservation Commission to approve and accept the
Conservation Restriction under the provisions of General Laws, Chapter
184, Sections 31, 32 and 33, as amended,and approves said Restriction.

RE: Request for Modified Subdivision Approval—Forest Glen II Subdivision
Approved October 27, 1966 and including Clear Spring Court
Dear Planning Board members:
The City of Northampton is the owner of three lots (lots 14, 15, and 16)which constitute the last
remaining undeveloped land in the Forest Glen II subdivision. Clear Spring Court, the road
which was designed to serve these lots and three others (Lots 11, 12, and 13)was never built and
is now a"paper" street.
Lots 11, 12, and 13 are now part of the Southview Acres subdivision and have access from
Woods Road. Lots 14, 15, and 16,the city owned lots are now land locked. The City has
issued a request for proposals to sell the lots to an abutting property owner,with the City holding
a conservation restriction to prevent the lots from being developed.
To clarify title, on behalf of the City of Northampton, I would like to request that the Planning
Board amend the 1966 Forest Glen II subdivision and delete Clear Spring Court as a road. Once
the road is dropped from the approved subdivision, it is my understanding that the title in the
road will go to abutting land owners.
