On November 16, 1977, the Zoning Board of Appeals for the City of
Northampton decided to grant the petition of Peter and Linda Demetropulos
for a variance to operate a beauty salon in an SR zone.
Based upon evidence presented to the Board, the Board made the
following findings:
1. There exists a special hardship owing to circumstances relating to
the soil conditions, shape, or topography of such land or structures,
but not affecting generally the zoning district. The lot is a large lot
of 42 acres. Along with a residential structure there is a prior non-
conforming business structure on the lot. The prior business use is not
being continued because of change in business conditions. The applicant
would sustain financial hardship if the building remained unused and vacan-
2. The desirable relief may be granted without substantial detriment
to the public good. There would be no detriment to the public good
because the proposed salon is set well back from Florence Road, and as
a part—time operation, would not have an adverse effect on abutters, nor
would it cause traffic congestion.
3 . The desirable relief may be granted without nullifying or substantiall-'
derogating from the intent of zoning. The intent of the Zoning Ordinance
would not be nullified because the proposed use would cause less noise,
dust , and pollution than did the construction business which had formerly
occupied the site.

OPINION OF THE PLANNING BOARD IN THE MATTER OF -
Request of Peter Demetropoulos for a variance to operate a beauty salon in
an SR zone -
The Planning Board, at its meeting of October 19, 1977, voted unani-
mously to express to the ZBA its opinion that the applicant be allowed to
withdraw his request for a variance and instead, submit an application for
a special permit under the provisions of "Home Occupation" or "Home Ser-
vice Occupation" . The Board noted that the finding of hardship, which is
a consequence of the application of the zoning ordinance, would be diffi-
cult to establish. The Board noted that the use, as such, is not incom-
patible with the area, in view of the fact that the area is very lightly
developed, therefore, the impact would be minimal. It did, however, feel
that the Board of Appeals and the Planning Board, being particularly
responsible for the zoning ordinance, should make it a point to insist
that applications of various kinds be made under appropriate sections. The
special permit process is provided specifically to deal with situations
of this type. There are special permit categories which can be interpreted
to cover the subject proposal .
