The Board of Appeals of the City of Northampton met on
November 30, 1983 , and voted unanimously to grant the special
permit request, brought under Sections 9.3 and 9 . 2, of David Haw-
fthorne to buy and sell used construction equipment at 339 West-
'; hampton Road. Present and voting were Chairman Robert C. Buscher,
, Dr. Peter Laband , and Kathleen Sheehan.
The Board' s decision was based on their finding that the
,; proposed use would be no more detrimental to the neighborhood than;
! the pre-existing, nonconforming use. The following conditions
Jwere imposed:
i
1 . The special permit shall be limited to the purchase and
sale of no more than ten pieces of equipment in any
given year.
2. The special permit shall be for three years , the time
period commencing on the day following the final day of
the appeal period.
3. There shall be no signs visible from Westhampton Road.
4. There shall be no storage of vehicles in the floor plain
area.
