Section 11 .7 - 'Comtiercial Stal-)le, Kennel , etc. For a commercial
sta',--)le, kennel or other such use requirin-

rules shall apply.
( a) The minimum acreage required shall be a parcel or tract of land
of at least ton (10) acres.

accessory facilities shall be located not less than one hundred
seventy-five (175) feet froin any street line and not less than
one hundred (100) feet from any side or rear lot line.
(c) The area to be used for the keen-ing of horses and/or Ponies shall
have adequate fencing to contain the animal (s) within the
property 'boundaries.
(d) Sufficient off-street Parking facilities should be Provided to
accommodate all users and visitors to the property, as deter-
mined by the Tloard of Trepeals.
(e) Stables, barns, corrals and yards shal'. be Tiro*perly drained and
reasonably free fron excessive odor, dust, and rqud, so as not
to create a nuisance or health hazard to the community or to
surrounding property owners , from an air or drainage pollution
standpoint.

The applicants request a special permit to allow the develonment

objections to the proposal and notes that it is in conformance with
the purposes and intent of the zoning ordinance and generally in
keening with the coriprehensive plan of the City.
The staff notes that there are proposed in the package of zoning
amendments adopted by the Planning Board in Priarch (copy attached) a
series of additional criteria regarding the operation of a commercial
stable. It is suggested that these criteria be considered carefully
in the review of the application.

The Planning Board, at its meeting of September 29, 1977 ,
voted unanimously to forward to the Board of Appeals its
opinion that the proposed application should be approved.
The Board noted, as did the staff reports attached, that the
proposed amend.nents to the zoning ordinance contained an item
relative to rmore specific criteria for co:-ncrcial stables .
These criteria, also attached, are suggested for consideration
by the Board of Appeals in establishing conditions for this
case.

ASSISTANT CITY SOLICITOR OF THE ZONING BOARD OF APPEALS
On October 5, 1977, the Zoning Board of Appeals for the City
of Northampton decided to grant the petition of Thomas Miranda and
Joseph Myers for a special permit to operate a stable.
Based upon evidence presented to the Board, the Board made the
following findings:
1) The use requested is listed in the Table of Use Regulations
as a special permit in the district for which application is made or
is so designated elsewhere in this Ordinance.
2 ) The requested use bears a positive relationship to the
public convenience or welfare since there are no other such facili-
ties in the City.
3 ) The requested use will not create undue traffic congestion,
or unduly impair pedestrian safety.
LE.) The requested use will not overload any public water,
drainage or sewer system or any other municipal system to such an
extent that the requested use or any developed use in the immediate
area or in any other area of the City will be unduly subjected to
hazards affecting health, safety, or the general welfare.
5) Any special regulations for the use, set forth in Article
XI, are fulfilled.
6) The requested use will not unduly impair the integrity or
character of the district or adjoining zones, nor be detrimental to
the health, morals, or welfare. The district will not be impaired
because other businesses are located in the vicinity.
The following conditions shall apply to this special permit:
1. The stable shall only be large enough for nine (9) horses.
2. This special permit is limited to the use as requested and for
no other commercial activity.
