The consolidation of waste from one or more sources at a common disposal site which is not designed or operated to guard against environmental pollution, has inadequate or no management, and way have associated with it such problems as vector breeding, fires.air pollution,, water pollution, odors, unsightliness, wasted land, nuisances, disease and accident pulentials. (9) Opt, r� aator. Any person who has care, charge. or control of a sanitary landfill facility subject to these regulations as agent or lessee of the owner or as an independent contractor. (10) Owner. Any person who alone or in conjunction with others owns the rem operty upon which is located a sanitary landfill facility subject to these regulations. (11) Person. Any individual, partnership, association, firm, company, corporation, department, agency, group, (including a city, town, county. State, or other governmental unit) or any other entity responsible in any way for an activity subject to these regulations. (12) Refuse. Putrescible or nonputrescible solid waste materials, consist ing of all combustible and noncombustible solid wastes including garbage and rubbish, but not including sewage. (13) Rubbish. Combustible or noncombustible solid waste material, except garbage and sewage, including but not limited to such material as paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, grass clippings. tin cans, metals, mineral matter, glass, crockery, dust, ashes, construction wastes, industrial wastes. commercial wastes, demolition wastes, agricultural wastes. abandoned vehicles, street ��--� sweepings, bulky wastes, the residue from the burning of wood, coal, coke or other combustible materials, and any other unwanted or discarded mattel. F (14) Sanitary Landfill. A method of disposing of solid wastes on land in such a manner as will protect the public health safety, comfort and erg: convenience and prevent a nuisance or a danger to the public health by CL reason of odor, dust, fires, smoke, air pollution, water ollution breeding or harboring of rodents, flies or vermin, or other cause. Such operation shall utilise the principles of scientific and engineering plann design and control to properly locate the landfill, to confine the refuse C� to the smallest practical area, to compact and reduce it to the smallest practical volume, and to cover it With a layer of material at the end of each day's operation or at more frequent intervals as may be necessary. (15) Solid Wastes. Any unwanted or discarded solid material. Solid wastes are classed as refuse (See definition 310 CMR 19.01(12) for Refuse) (16) S ecial Wastes. Parsons (413)586-6950 Ezt.213 April 9, 1984 Edwin & Julia Matusko Ryan Road Northampton, MA 01060 Dear Mr. & Mrs. Matusko: Re: Dumping_- Lot 186, Map 35 An inspection, this date, of your property fronting on Ryan Road, Map 35, Lot 186 revealed that a large volume of rubbish, tree stumps, brush, demoli- tion wastes, and cement block manufacturing wastes has been dumped there and used as fill material. Please be advised that this dumping and burial of rubbish in an area not ap- proved as a sanitary landfill is a violation of Section 150A of Chapter III of the Massachusetts general laws and is also a public health nuisance. Under authority of Chapter 111, Section 123 and 150A you are hereby ordered to cease the dumping of rubbish immediately and to remove and properly dispose of the dumped material within seven (7) days of the receipt of this notice. Attached for your information is an excerpt of the Massachusetts Department of Environmental Quality Engineering regulation for "the disposal of solid waste by sanitary landfill", (Section 19.01 - 310 CHR 19:00) which defines the term rubbish.
