I made a site inspection approx. 4 :20PM found that Mr. Racicot had eight vehicles (unregistered) on property informed him that he was in violation of ordinace allowing him only six unregistered vehicles. Letter of violation sent to him registered mail. 30 days to remove two vehicles. A Patillo r Page 2 Log for 1 Pine Valley lot 35 parcel 175 3/14/96 Mr. Jack McKenna called 3/13/96 stated that "Another junk just got delivered and dumped" at Mr. Racicot' s . I made a site inspection on 3/13/96 at approx. 4PM. The car that had been on Mr. Racicots truck on site inspections that I had made on Nov 29 , 1995, Feb 25, Feb. 26, and Feb 29 1996 was no longer on his truck but had been moved inside of the fenced in area. I spoke with Mr. Racicot about the complaint received in our office by Mr. Mckenna. He stated the car had been on his truck and that it belonged to his daughter. He also stated that it was going to have body work done, he had taken the car off of his truck so that he could use his truck to haul trash to the dump. He also stated that he will have his daughter send this office a letter stating her ownership of the vehicle and that it was on her fathers truck ready to be sent to body shop not to be stripped or sold for scrap, she intends on using vehicle for her personal use. A. Patillo 3/14/96 CC Mayor Ford Councilor Harrington Mr. Racicot Mr. Mckenna Log for inspections 1 Pine Valley Rd. lot 35 parcel 175 10/24/95 Mr. McKenna called stated that junk cars were being stripped at Mr. Racicot's property. Visted site approx 4 : 50PM found no cars being stripped. proper number of unregistered cars in fenced in area. No violations. A. Patillo 11/29/95 Message on phone machine from Mr. McKenna that there were cars about to be stripped. Visited site at approx. 7 : 50PM, there was one car on Mr. Racicot's truck no cars in lot, six cars in fenced in area. No violations. A. Patillo 2/25/96 (Sunday) in response to councilor Harrington a site visit was made at approx LOAM . There was one unregistered vehicle in Mr. Racicot' s driveway in front of his garage and one unregistered vehicle on a flat bed truck, the flat bed truck belongs to Mr. Racicot and is registered. No violations. A Patillo 2/26/96 A site inspection was made to 1 Pine Valley rd. at approx. 7AM. The same vehicle was in driveway and the same vehicle was on flat bed truck as seen on 2/25/96 inspection. No violations. A Patillo 2/29/96 A site inspection was made to 1 pine Valley Rd. at approx 3 : 30PM, the vehicle that was in driveway was no longer there and vehicle that was on truck on inspection of 2/26/96 and 2/25/96 was still on flat bed of truck. I spoke briefly with Mr. Racicot and informed him of complaints being made to Councilor Harrington by Mr. McKenna, he replied that he has not violated the zoning ordinaces and that he feels he is being harassed by Mr. McKenna. I spoke with councilor Harrington and explained the visits that I had made finding no violations, Mr. Harrington said he went by and saw two trailers and the vehicles that I had seen. I explained that the trailers are allowed if registered. I will add at this point I feel it is harrassing Mr. Racicot to continue with these inspections seeing that the only person to complain in the neighborhood is Mr. McKenna. It should also be noted that the road that serves Pine Valley is a private road that Mr. Racicot installed. No Violations. I am a resident of 1345 Burts Pit Road, Northampton. 2 . Since July of 1991 I have observed on numerous occasions the delivery of vehicles to the residence of Mr. Robert Racicot. Some of these vehicles were stripped while on the property of Mr. Racicot. Some of these vehicles were repaired. Sworn under penalties of perjury this eighth day of May, 1992 . I am the Building Inspector for the !City of Northampton. 2 . On May 8, 1992 I visited the property of Robert Racicot, 1 Pine Valley Road, Northampton, and I observed two unregistered vehicles and parts of others. These vehicles were unscreened from the public's view. This is a violation of the Northampton ordinance with regard to unregistered vehicles. The court at that time ordered the defendant to cease operation of an illegal auto repair business and to cease the illegal storage of junk vehicles. The defendant has violated both conditions, as evidenced by the attached affidavits of Mr. John McKenna and Building Inspector Frank Sienkiewicz. Therefore the Commonwealth moves this honorable court to hold the defendant in contempt and to impose the $100 per day fine specified in the court's order. /red M. I made a site inspection to your property on 4/24/96 at approx. 4 :20PM and found that you have more than the (six) unregistered vehicles permitted to you by City Council. I counted eight vehicles, therefore you must remove two of the vehicles. You have thirty days from the receipt of this letter to remove the vehicles. Northampton, MA. 01060 April 26, 1996 Subject: Storage of Building materials & operation of Masonry Business in Zone SR, map 35 lot 169 Mr. Mckenna, A complaint was filed in our office stating that you were operating a masonry business and storing materials and machinery for said business from 1345 Burts Pit. I made a site inspection at approx. 7 :45AM on April 26, 1996 and found that you have stored on site masonry materials and equipment. The zone that you are in SR does not allow the storage of building material or equipment for businesses. I also checked the file to see if you have registered for home office or occupation and found that you have not registered with the city which is required. You have thirty days to remove the materials. You may pick up the application in our office to register for home occupation/office, our hours are 8: 30am to 4 : 30PM Mon. - Fri. except on Wed. when we close to public at noon.
