NOV 1 81987 DECISION OF n- tK) ZONING BOARD OF APPEALS T1. At a meeting held on November 4, 1987, the Zoning Board of Appeals of the City of Northampton voted unanimously to deny the appeal of Henry Kabat, 884 Ryan Road, Florence, MA, for"ne- purpose of appealing a decision of the Building Inspector for non-action on a complaint regarding property located at 7 Pine valley Rte, Northampton, MA. Present and voting were: Acting Chairman Peter Laband, Irene David and Sanford Weil, Jr. �i The findings were as follows: g I S. Weil found, after making two site visits and after r discussion with the Building Inspector, that the charges brought forth by Mr. Kabat were greatly exaggerated, as the specific items that were referred to by Mr. Kabat were not found and the site, as it now exists, represents a non- hazardous situation. He voted to deny the appeal. I. David found, after inspection of the property, that this is a complex complaint, which could represent an uncomfortable neighborhood situation. She addressed the six areas that were listed on the formal complaint, including: 1. Violation of permit for dumping of fill, volume in excess of 1985 permit granting 499 c.y. of clean fill. Ms. David stated that under the provisions of the Northampton Zoning Ordinance, 499 c.y. of fill is allowed. 2. Dumping hazardous materials from sewer construction on Ryan Road consisting of blacktop, oil laden gravel from roadway. Ms. David stated that as construction of Ryan Road was done by the City, she would expect that no illegal material was used. 3 . Dumping of tree stumps from James Boyle, Burts Pit Road project by Osley Construction Co. Ms. David found no evidence of tree stumps as the property exists now. 4. Dumping of automobile gasoline tanks removed from junk cars, estimated to be about 30 units. Ms. David found no evidence of gasoline tanks on the property as it exists now. She noted that extensive digging would have to be undertaken to ji make a positive determination. t' 5. Dumping used automobile tires, 250 units. Ms. David found no evidence of automobile tires on the property as it exists j now. ii 6. Concrete wastes by John McKenna, Mason Contractor. Ms. �j David found that some concrete ridges are present, however, j they appear to be used by the Schorges as garden terraces and steps. She also voted to deny ,the appeal. flP. Laband concurred, finding that: 1. Technically the time limitations for this appeal were exceeded; and 2 .
