The reasons upon which this Petition is based are as follows: Conditions Affecting the Subject Parcel but Not Generally the Zoning District. The land for which this variance is requested is not suitable for any purpose that the present zoning would permit. It is especially unsuitable for residential use as it is physically hilly and rocky and is abutted by a cemetery, by an exhausted gravel pit, by two barns, and by the present owners who are desirous of selling this land. Also nearby is an active gravel pit and a swampy conservation area. Literal Enforcement of the Zoning By-Laws Would Involve Sub- stantial Hardship to the Petitioner. The Petitioner is presently renting separate administrative and garage space. The present garage, is only 30' by 30 ' , and has no heat nor any utilities except electricity. This presents two serious and distinct problems for the Petitioner: (1) Due to the inadequate size of the garage space, the Petitioner cannot secure its construction equipment at night, and has suffered substantial and very costly damages from vandalism. (2) Due to the lack of utilities at the garage, the Petitioner is unable to do normal maintenance and small repairs on its own vehicles. It, therefore, must contract independently, at higher rates for the repair and maintenance of its machinery. These two excessive costs place the Petitioner at a severe competitive disadvantage. The Petitioner has sought other space in the City of Northampton, but has been unsuccessful in locating adequate space in a suitably zoned district. Desirable Relief May Be Granted Without Detriment to the Public Good and Without Nullifying or Derogating From the Intent or Purpose of the Zoning By-Law. The granting of the variance to the Petitioner offers a rare opportunity to utilize this otherwise almost worthless piece of land. The use would certainly be consistent with the immediate surroundings and would allow the Petitioner to remain in the City of Northampton on equal footing with its competition.
