The Zoning Board of Appeals for the City of Northampton met on July 28,
1982 and denied the petition of Donald Pottern for a special permit to add a i
second floor to the Furniture Gallery at 1 7 x;ng Street. The vote taken was
two in favor and one opposed, and since the vote to approve was not unanimous,
the petition was denied.
Based upon the evidence presented to the Board, the Board made the follow-
ing findings in regard to the request for a special permit:
1. Marianne Zurn found that the second floor would not be more
substantially detrimental to the neighborhood than the exist-
ing nonconforming use. She believed that having room to
store merchandise would decrease the amount of traffic be-
cause trucks would make fewer deliveries. Further, she found
that enlarging the storage area would not necessarily increase
the number of customers. She voted to approve the special. per-
mit.

2. Mr. William Brandt agreed with the findings of Ms. Zurn in that
the proposal would not be more detrimental than the previous
nonconcorming use. He voted to approve the project, subject to
the following conditions:
a. The second floor shall at no time be used for retail space,
nor shall it be used for display or sale of merchandise.

b. If, at anytime, the Police Chief or the Zoning Board of
Appeals determines that the Furniture Gallery is generating
a substantial increase in traffic, the applicant shall pro-
vide space for customer parking.
c. As recommended by the Planning Board, the addition shall be
constructed so that it blends with the existing building.
3. Dr. Peter Laband found that the present use of the building is
already a contributor to the unsolvable traffic problems on
King Street, and an enlarging of the building would mean an
increase in customers, thus aggravating the existing traffic
congestion.
4. He further found that there is insufficient parking space and
the owner of the property has no firm commitment on the acquisi-
tion of additional parking space. Because of these reasons, Dr.
Leband voted to deny the petition for a special permit.
The vote to approve not being unanimous, t e petition is denied.
