Pursuant to your request, enclosed please find a new Zoning Permit Application seeking to modify the garage under construction, together with modified plans . My clients ' position is that no Finding is required because once the garage is moved back 12" , there will be no increase in the nonconforming nature of the structure. The Labarge plan submitted by Mr. Mailloux shows a foundation setback of . 97 feet. The Eaton plot plan, attached, shows the old car port having a setback of . 96 feet. Thus the setback distance will be slightly increased. Additionally, since Mr. Mailloux is willing to sign an agreement, and this agreement will be recorded at the Registry, no future owners will have any grounds to complain.
