Pursuant to your request, enclosed please find a new Zoning Permit Application seeking to modify the garage under construction, together with modified plans . My clients , position is that no Finding is required because once the garage is moved back 12" , there will be no increase in the nonconforming nature of the structure. The Labarge plan submitted by Mr. Mailloux shows a foundation setback of .97 feet. .. The Eaton plot plan, attached, shows the old car port having a setback of .96 feet. Thus the setback distance will be slightly increased. Additionally, since Mr. Mailloux is willing to sign an agreement, and this agreement will be recorded at the Registry, no future owners will have any grounds to complain. If you disagree with this statement, I respectfully request that you have the City attorney contact me. Please notify me of your decision as soon as possible. There are two additional issues that I would like to address . First, the temporary certificate of occupancy issued by your office has expired. My understanding is that you are to meet with the City Solicitor before acting on my clients , request for a zoning permit. Additionally, there were two matters I raised in my letter of December 2, 1994 which have gone unanswered. Specifically, I asked about extension of the temporary occupancy permit and about the propriety of protecting the unfinished work despite the existence of the stop work order. Please see the attached copy of my earlier letter for more detail.
