29-473 (6) o �..r DECISION OF NORTHAMPTON PLANNING BOARD At a meeting held on October 10, 1985, the Planning Board of the City of Northampton voted unanimously to grant the Special Permit request of I Fairway Associates, Inc. , Gerald Jackson, President, P.O. Box 1209, !, Northampton for the purpose of establishing a Cluster Residential Development to include 24 units on 16 lots (plus an existing single family dwelling) on 13+ acres located on the west side of Florence Road, Northampton and containing a new roadway entitled "Indian Hill". Public Hearing for this application was held on September 19, 1985. Based upon evidence presented to the Board at said Public Hearing and after due deliberation, the Planning Board issues the following findings in accordance with Section 10.10 of the Northampton Zoning Ordinance: 1. That the requested use is listed in the Table of Use Regulations of the I Northampton Zoning Ordinance as allowed by Special Permit in the district for which application is made. 2. The requested use bears a positive relationship to the public convenience or welfare by increasing the number and quality of the City's housing I stock. 3. The requested use (proposed 24 units on 16 lots) will not create undue j traffic congestion or unduly impair pedestrian safety. I 4. The requested use will not overload any public water, drainage or sewer system to such an extent that the requested or any developed use in the immediate area or in any other area of the City will be unduly subjected to hazards affecting health, safety or the general welfare. 5. All specific regulations for the use, set forth in Article XI have been fulfilled. 6. The requested usewill not impair the integrity or character of the district or adjoining zones, nor is it detrimental to the health, morals or general welfare. The use is in harmony with the general purpose and intent of the Ordinance. The proposed development is creating single, two and three-family housing in a similar neighborhood. In addition, the Planning Board attaches the following conditions to this Special Permit: I 1. That the area enclosed in the loop roadway be a part of the i common open space. 2. That adjacent lots shall share a common curb cut, unless topography dictates otherwise (to be determined on the field by the DPW). 3. That no more than two "plex" dwellings (two or three family) shall be located on abutting lots (not including lots across the street), I as the intent of the Ordinance is to provide a mixture of single ` and "plex" housing. 4. That this Special Permit is subject to the provisions and conditions of the Planning Board's approval of the Definitive Subdivision Plan, entitled "Indian Hill Subdivision", filed with the City Clerk on 8/12/85 and approved by the Planning Board on 10/10/85. The request for a 3" total depth of bituminous paving material in lieu of the required 5+" is granted. b. The request for a sloped bituminous "Cape Cod" style berm in lieu of a vertical bituminous berm is granted. c. The request for no sidewalks is granted. d. The request for acceptance of a+ 985 ft. dead-end street as presented on the Definitive Plan is granted. e. The request for a reduction in the frontage distance to 80 percent of the usual distance for those lots on the cul-de-sac is granted for lots #3, 4, 5, 6, 7, 8, 9, 10, 11, and 12. f. The request for a 24 ft. width for the paved surface between the berms is denied. A verbal request for a 26 ft. wide roadway from face to face of berm is granted. g. The request for a minimum centerline radius of curvature of 240 feet for the first + 200 feet of raod alignment is granted. 3. All conditions of the Conservation Commission's Order of Conditions are to become a part of this Order of Conditions. 4. The developer shall notify in writing the DPW and Planning Board five days in advance of the date of commencement of construction, subsequent phases of construction so that proper inspection can take place. 5. The applicant shall provide the City with a Performance Guarantee, subject to approval of the Planning Board, City Solicitor, prior to the commencement of construction. Said Performance Guarantee may take the form of either 1) a covenant or 2) a bond, deposit of money or negotiable security in conformance with the provisions of Section 81-U of Chapter 41, MGL. Should the developer choose a bond, deposit of money or negotiable security, then the developer shall complete all public roads and utilities nine months prior to expiration date of bond to enable the city to draw upon bond if necessary. - The monetary value of the bond shall be agreed upon by the DPW and shall be 100 % of the cost of completion as of the date the bond expires. 6 Due to the proximity of this development to the Clark Street well, the developer shall place deed restrictions to prohibit commercial applications ` C7> of pesticides, insecticides, fungicides, biocides and fertilizers oil any lots f in this development. T. Referring to the submitted Definitive Plan: a. Under water system, corporations to be Red Hed Brass. ._ b. Words "w/ waste" under curb stops to be stricken out. Proposed rip rap to be at least 30 feet long with a minimum side stone of 50 pounds and appropirate energy dissapators. 9. The developer shall grant to the City 30 foot wide drainage and sanitary sewer easements for all drainage and sanitary sewer pipes located outside the layout of the proposed street as shown on the submitted construction plans. The easements for the drainage system shall include the riprapped area past the proposed headwall at the outlet of said drainage pipes. Said easements to be approved by the City Solicitor and the submitted plans to be amended accordingly prior to commencement of construction. 10. The developer shall present as-built plans on mylar for endorsemern by the Planning Board. The following recommendations of the Department of Public Works as stated in letter dated 10/9/85 to G. Tobin, Chairman, Planning Board are to be addressed by the developer: a. Bench mark and companion is not shown on construction plans. 6. It appears that the drainage system drains on or near -the aquifer to the City of Northampton Clark Street Well. c. The Definitive Subdivision as submitted appears to be sloping and draining toward the aquifer of the 'Clark Street Well, which may be a recharge area for the Well. This area is subject to review by the Commonwealth of Massachusetts Department of Environmental Quality Engineering (DEQE). This Subdivision Approval is contigent upon any conditions imposed by the DEQE. d. Street-line radii at the entrance of development must be shown on the plans. e. Catch basin to catch basin drainage connections are not acceptable. Storm system from station 3+00 to station 6+65 shall be constructed ° so that the drain line does not cross the proposed sanitary sewer. f. Storm drainage calculations have not been received by the DPW or Planning Board; drainage grads need further review. The slope of drainage from manhole 6+65 to the- proposed outlet shall be minimal to ensure slow velocity of drainage discharge out in the open, said slope not to exceed 2 percent. This may necessitate a drop manhole at station 6+65. g. Two catch basins should be installed at Station 7+00, all catch basin sump shall be 30" in depth. h. Water main shall be ductile iron pipe (see Legend). i. Water main shall be a looped system within the development. j . Hydrants shall be placed at station 0+25 RT, 2+90 RT and 6+80 RT, 5 feet off the berm and shall conform to City of Northampton, Department of Public Works specifications. k. The Department of Environmental Quality Engineering (DEQE) to address and set restrictions on the use of fertilizers and/or chemicals for insect pest control. 1. INTRODUCTION The Applicant makes this Application for a Special Permit to construct a 16 lot Cluster Residential Development on 13.51+ acres off Florence Road in Northampton. The area is zoned URA and is mixed with single family and multi-family homes on a variety of lot sizes. The proposed development is across the street from Florence Heights which is owned and operated by the Northampton Housing Authority. The character of the land is lightly wooded as a result of having been thoroughly logged in the late 1960',s. The land slopes gradually to the northwest and affords some pleasant views in that direction. The Applicant has chosen to propose a Cluster type subdivision rather than a conventional subdivision so as to achieve the following goals: 1. The dedication of nearly half the total area to Open Space, 2. The ability to mix housing types so as to create a wider variety of housing types for the "starter home" market which is heavily ensconced in the immediate Florence Road area, 3. The ability to mix single and two and three-family homes in one project so as to promote a socio-economic mix which is perceived as vital to the community's vitality and diversity, 4. The ability to "downscale" site improvement construction for a more pleasant and limited impact upon the landscape, 5. The ability to respond accurately to the demands of those buyers in the housing market who cannot purchase affordable housing given recent trends in development of housing in the community. While endeavoring to achieve these goals and opportunities, the Applicant is also submitting application for Definitive Plan Approval and proposes to construct all site improvements to the design standards of the City's Subdivision Regulations, with the exception of the waivers requested herein. It is intended that the Open Space be owned and managed by the homeowners and that the road and utility systems be built to City satisfaction and then properly dedicated.
