WHEREAS, the Northampton Open Space and Recreation Plan, 2000-2004, adopted by the
el
Planning Board, Recreation Commission, Conservation Commission , and City
Council,recommends preserving open space in the Mineral Hills and expanding the
Mineral Hills Conservation Area; and
WHEREAS, Tris Metcalf and Thomas Fortier have offered to donate 2.25 acres,more or less, in
the Mineral Hills near the Mineral Hills Conservation Area as a condition of a
Special Permit they obtained; and
WHEREAS, Because this property has no capital improvements,the maintenance responsibilities
are negligible; and
NOW, THEREFORE BE IT ORDER-ED,
The City Council hereby authorizes the City of Northampton,acting through its
Conservation Commission, to accept said donation of land for the purpose of
passive recreation and conservation consistent with Article 97 of the
Amendments to the Constitution of Massachusetts.

its Conservation Commission for open space conservation purposes, consistent thereby with
Article 97 of the Articles of Amendments to the Constitution of the Commonwealth of
Massachusetts
Parcels A2 and B2, Turkey Hill Road, Northampton, Hampshire County,
Massachusetts, consisting of approx. 48,000 square feet each for a total area of 96,000
square feet, approx., as described on a Plan entitled "PLAN OF LAND IN NORTHAMPTON,
MASSACHUSETTS, HAMPSHIRE COUNTY PREPARED FOR THOMAS FORTIER &
TRIS'TRAM METCALFE" by Huntley Associated, P.C., dated August 7, 2003, recorded in
the Hampshire County Registry of Deeds in Plan Book 198, Page 23, bounded:
Northerly, Easterly and Westerly by land now or formerly of ANDREW L. CHAMBERS
AND DONNA N. CHAMBERS, as shown on said plan; and
Southerly by Turkey Hill Road, and Parcels Al, B3, and B1.
All as shown on the aforementioned plan which shall be controlling for all purposes.
Said land to be used by the City of Northampton only for conservation purposes.
