This letter is to confirm our conversation on this date. I related to you today that this office recently received a complaint regarding the conditions of the exterior of your property. The complaint was that there are numerous items strewn about and piled in the rear and side yards of your property. This situation can create an d attract a potential rodent and vermin harborage area to the neighborhood, which is a public health concern to this Department. The complainant also alleged that was several unregistered vehicles in the driveway and that the driveway was fully cluttered with all various types of items and equipment. A site visit was made by representatives of this office on February 17, 2005, and the complaint was verified. Today, you assured me that you would begin cleaning your yard by removing the items in a timely manner. I informed you that this office will conduct periodic checks-to determine progress. If progress is not moving forward satisfactorily, you will receive a formal letter ordering cleanup of the property. I have made several visits to your site as yopu well know, the last visit was today where we talked about the clean up you had promised to take place "once spring arrives" I count three vehicles that are unregistered and two backhoes that are also unregistered. Northampton Zoning section 8.9-12 states that"no more than two unregistered motor vehicles (any vehicle that does not have a valid registration legally issued by a 'governmental authority) and no motor vehicle accessories which are not parts of said two vehicles may be parked, stored or otherwise placed on a parcel of land in the city of Northampton without a special permit..." Section 8.9-13 also states all permitted unregistered motor vehicles or parts thereof shall be screened from public view of the public and abutting public ways and from abutting properties within a structure or sight impervious fencing or screening." MOTOR VEHICLE: Any vehicle self propelled by a battery powered, electric or internal combustion engine, which are permitted and requires a valid registration legally issued by a governmental authority in order to be operated on a public way. Section 8.9 Parking and Loading Space Standards. All parking and loading areas shall comply with the following: 10. Except on a farm, not more than one commercial vehicle, and said vehicle shall not exceed a weight of 10,000 pounds gross weight shall be garaged or in any way stored on any lot in any Residential (R) District. 12. No more than two (2) unregistered motor vehicles (any vehicle that does not have a valid Registration legally issued by a governmental authority), and no motor vehicle accessories which are not parts of said two vehicles, may be parked, stored or otherwise placed on a parcel of land in the City of Northampton without a Special permit from the Zoning Board of Appeals. This section shall not apply to the parking, storage or otherwise placing of unregistered motor vehicles and/or motor vehicle accessories where such parking, storage or placement is in connection with a legally established business selling new and/or used automobiles and trucks, or automotive repair or automobile service stations. This section shall also not apply to trucks and tractors which are in use for bona-fide agricultural purposes. 13. Ramsden 375-Brook-side Circle Florence, MA 01062 May 2006 Dear Richard and Diana, We have received a complaint from about the presence of unregistered vehicles, junk vehicles, vehicle parts, and construction materials on your property at 375 Brookside Circle, along with the use of that property as a contractor's yard. Upon investigation, we find that there are, in fact, a number of unregistered or junk vehicles and motor vehicle accessories visible from the street and that there is evidence that suggests the use of your property as a contractor's yard. In addition, the deck attached to the back of your house appears to be in such a state of disrepair as to constitute a danger to life or limb. The City of Northampton's Zoning Ordinances (sections 2, 5.2 and 8.9) limit the number of unregistered vehicles allowed on residential property, define the difference between unregistered and junk vehicles and describe the requirements for storing the unregistered vehicles and motor vehicle accessories that are permitted. Only two unregistered vehicles, and no junk vehicles are allowed per parcel of residential land in the city without a Special Permit from the Zoning Board of Appeals. The allowed vehicles and parts must be screened from the view of the public. The City of Northampton's Zoning Ordinances (section 5.2) prohibits the use of property as a Contractor's yard in any residential zone. The Massachusetts State Building Code (780 CMR chapter 1, section 121.2) requires that any structure appearing to be "dangerous to life or limb" be inspected, and if found to be so, made safe. The deck attached to the rear of your house would seem to be unsafe, and the deteriorated condition of the roof may also present hazards to the occupants of the dwelling. It appears that you are in violation of the above-referenced sections of the City of Northampton's Zoning ordinances and the Massachusetts State Building Code. I have included excerpts from these ordinances and codes for your reference. Please make arrangements to have the junk vehicles, parts and any unregistered vehicles beyond the allowed number removed, and the remaining unregistered vehicles stored in an appropriate manner in the immediate future. When I left the phone message thanking you for your help in the matter, I was pleased with the improvements that had been made-a portable garage in the driveway covers a lot of the clutter,junk had been removed from the backyard and tarps covered the rusty backhoe and tractors. Relative to the initial mess, the yard looked better. Mr. Ramsden claimed that repairs were going to be made to the house. The tarp covering the leaky roof is still there. No repairs have been made. The summons presented to him questioned whether the house was fit for human habitation. Does the Health Department and Building Inspector's office follow-up on houses that are in such disrepair? The tarps have blown off the machinery and not been replaced. A homeowner who cared about his property and his neighbors would not have this junk to begin with, would not have to be forced to cover it, and would secure the tarps so they stay in place. Isn't there a city ordinance or something against having construction equipment in a residential neighborhood?There is also a dump truck. The pile of wood which was mentioned as"a nuisance and source of harborage for vermin and rodents" remains. The Ramsdens seem to feel that they can do as they please without regard for the effect it has on the property values around them. Given the fact that I was verbally confronted by Mrs. Ramsden about a complaint that I didn't make to the Health Department before I started working with you on the problem and Mr. Ramsden was "extremely confrontational"when Ernie stopped by last year, I am not inclined to try talking to them about the issue and still don not want my name mentioned unless absolutely necessary. I have to live next to these people. I have made arrangements with Fitzgerald Fence to have a fence installed along that side of my property. I have resisted doing this for years because I can't afford it and felt it was not my responsibility since I am not causing the problem, but I am totally fed up with living next to a dump. My father has very generously offered to pay for the fence-$2100.00. An interesting fact- when I spoke with a surveyor in Hadley about determining exactly where my property lines are, he asked the name of the neighbor who is causing the problem. When I told him, he refused the job. He knows Mr Ramsden and he"doesn't want to be the one to have to tell him that there is any problem with the property line", should there be one. No matter what I do to my property, there is still a mess just a few feet away. Anything you can do or suggest will be greatly appreciated. I shouldn't have settled for the small improvements that were made last year. 375 Brookside Circle is the worst mess in the area and the situation needs to be dealt with, once and for all.
