32C-353 ADVERTISMENET FOR NOTICE OF HEARING
Upon request of Mr. Anthony Patillo, Building Commissioner of the City of
Northampton, Massachusetts, pursuant to Massachusetts General Laws, Chapter 40,
Section 54A, the Executive Office of Transportation and Construction shall conduct a
hearing to determine whether a building permit shall be issued to Park Homes, Inc. of a
two (2) building fourteen (14) unit Condominium located at North side Hockanum Road,
Northampton, Massachusetts Assessors Map 32C, Parcel 353, and bound by the land as
described on Exhibit "A" attached hereto. The parcel of land includes part of the
properties formerly of the Boston and Maine Corporation.
The hearing will take place on at at the
Executive Office of Transportation and Construction, Suite 3170, located in the
Transportation Building, Ten Park Plaza, Boston, MA 02116. All interested parties
should attend. Inquiries concerning the hearing may be made to the Office of the Rail
Unit, Executive Office of Transportation and Construction at 617-973-7011.

PARK HOMES, INC. has requested a permit to build a two building, 14 unit
Condominium in Northampton, Massachusetts. The property for which the permit is
requested is located at North side Hockanum Road, Parcel 353, Assessors Map 32C. The
parcel of land includes part of the properties formerly of the Boston and Maine
Corporation.
In accordance with Massachusetts General Law, Chapter 40, Section 54A, a permit shall
not be issued without first obtaining, after a public hearing,the consent in writing to the
issuance of such permit from the Secretary of the Executive Office of Transportation and
Construction(EOTC).
I hereby request that a public hearing be held for Park Homes, Inc. to determine whether
consent will be granted by EOTC to construct the above on former railroad property.

After reviewing information on file at our office, it has been determined that the proposed
construction does not adversely impact any potential transportation use. This being the case, I
hereby consent by means of two original letters, one Northampton's Building Inspector and another
to the Applicant for the building permit.
This consent is contingent upon the agreed language received in letter dated January 6,2005
from the applicant's attorney Mark J. Beglane responding to the hearing officer's request for

anguage to be incorporated in the condominium's lease and/or purchase and sales agreement.
Fencing must also be erected along the railroad's active right-of-way.

I am writing with respect to your request for my consent to the issuance of a building permit

Daily Hampshire Gazette on Thursday, December 2, 2004.
Massachusetts General Laws, Chapter 40, Section 54A provides that a city or town must
obtain the consent of the Secretary of Transportation prior to the issuance of a building permit for
any structures on lands formerly used as a railroad right-of-way or lands appurtenant thereto
formerly used by any railroad company in the Commonwealth. The explicit purpose of the statute
is to preserve former railroad property in the Commonwealth for present or future transportation-
related uses. As the executive officer responsible for comprehensive planning in the areas of
transportation, I have the obligation under the statute to protect such property for transportation-
related uses.
