SUBJECT: Zoning question--Pizza Express building,
Pleasant St.

I discussed the situation with the former Pizza Express location
with Wayne. Nini's wants to put a take-out pizza business in that
location. A take-out food establishment in that zoning district
currently requires a special permit. Pizza Express was a non-
conforming use. However, the protection afforded a non-conforming
use expires in two years if the use ceases to be active. Pizza
Express has been closed for well over two years. Therefore, Nini's
cannot avail itself of the non-conforming status.
It will be necessary for Nini's to apply for a special permit to
establish a take-out food business on that site.
