William Brandt moved to close the Public Hearing. Alex Ghiselin seconded the motion which passed unanimously 3: 0. The Board reviewed §9. 3 (1) (D) of the Zoning Ordinance which allows a Finding to be granted if the ZBA finds that the change, extension or alteration will not be substantially more detrimental to the neighborhood than the existing nonconforming structure and use. Since the requested alteration would not be substantially more detrimental to the neighborhood than the existing structure, William Brandt moved to approve the Northampton Revolver Club's request for a Finding with the following condition: 1. Prior to obtaining a Building Permit, the applicant shall submit a professional opinion that the decibel level of noise from the new indoor shooting range shall be less than the decibel level of the old structure, based upon the design and/or architecture of the new facility. It shall be submitted to the Zoning Board and become part of this new application as proof of noise reduction. Alex Ghiselin seconded the motion which passed unanimously 3:0. C..- -6- T ZBA Meeting Minutes - January 4, 1995 Club haQ been a good neighbor over the years and a good friend of the Police Department since it gives priority to the Department for use of the range. He said that it would be helpful to the police if the new structure was built since it would afford more opportunities for training with a 75' shooting range. He said there is no outdoor shooting allowed during school hours and that the Club understands that they must cooperate with its neighbors. Jekanowski said he wanted to continue the discussion of acoustics and noise levels from the range. He said that the Club had responded to a complaint from a neighbor on Matthiew Drive during the past year. The Club officers had measured noise levels near the outside of the existing building and had at a 97 decibel reading, down-range of the ports the decibel level was 103 , and on Matthiew Drive the level was 50 decibels. Jekanowski said the Club decided that, based on the noise levels and readings, they would make the expenditure to insulate the building with fiberglass batting and polystyrene which made a significant decrease in the decibel level. He said that the Club wanted to make sure they took the necessary steps to remain good neighbors. The new building will provide added safety and noise level reduction to the neighborhood. He said that there is no shooting allowed after dusk. The Club has been in business for 61 years and they have never had a fire arms injury. He said that violations to the Club rules are not tolerated, and that the rules are strictly enforced. Jekanowski said that the Club provides a safe place to shoot for club members as well as for members of the Northampton Police Department and the Hampshire County Sherriff's Department, and members of the community. Fran Taylor, Sargent with the Hampshire County Sherriff's Department was present to voice support for the Northampton Revolver Club's proposal. He said the Club has always been very kind to the Sherriff's department and allowed them use of the range anytime it was needed. Taylor said the Sherriff's Department uses the range for fire arms training every year and that the new range would accommodate the new police ammunition which the Department now uses. He said that the Revolver Club has always been an important asset to the Sherriff's Department. Vice Chair Weil asked if anyone was present to speak against the proposal. No one spoke in opposition to the proposal. Vice Chair Weil asked if anyone wished to make additional comments neither for or against. Jerry Millane, 67 Spruce Hill Avenue, was present to express concern about the noise in the neighborhood. Millane said he had just moved to the neighborhood in August and had been unaware of the fact that the Club was in the midst of the neighborhood. He said he sometimes thought the shooting noise from the range "sounded like World War III" . He further noted that after the shooting was over, ' the dogs in the neighborhood, who had been frightened by the noise, would often continue barking and further exacerbate the noise level of the neighborhood. -5- r 4, w ZBA Meeting Minutes of January 4, 1995 ea' Vice Chair Weil opened the Public Hearing on the request of the Northampton Revolver Club for a Finding under §9. 3 of the Zoning Ordinance for an expansion of a pre-existing, non-conforming structure in a residential district at 519 Ryan Road. Present and sitting on the case were: Vice Chair M. Sanford Weil, Jr. , Associate Member William R. Brandt, and Member Alex Ghiselin. A Legal Notice of this public hearing was published in the Daily Hampshire Gazette on December 21, 1994 and December 28, 1994 . Vice Chair Weil reviewed procedures for conducting public hearings. Paulette Kuzdeba said that the DPW had responded with no concerns on the proposal. Robert Jekanowski of 423 Acrebrook Drive, Treasurer of the Northampton Revolver Club was present to discuss the proposal to remove an existing firing range and to construct a new 40' X 85' indoor shooting range at 519 Ryan Road. Jekanowski said that the firing range had been on the property since 1952 , and they now want to demolish the old structure and replace it with a newer, safer, brighter, and more modern indoor shooting range. The Club will not increase the number of ports, which is ten, but will increase the width of each port by a few inches. There will be both 50' and 75' shooting ranges which conform to standards for modern ranges. Jekanowski said that the new structure will have sound-proofing and more insulation which will help filter the noise level and make the new structure a lot quieter than the existing building. The new building will be at ground level and there will be no underground range which should also reduce the decibel level at the range since noise travelling underground is louder than noise at ground level. Bill Brandt said that a professional opinion might be needed to qualify the decibel measurements and noise levels represented to the ZBA. Paulette Kuzdeba suggested that the Board could impose a condition on the permit which would call for a professional opinion verifying that the noise level would be reduced with the new building. Bill Brandt asked whether there would be an increase in the hours of operation. Mr. Jekanowski said that State Law mandates the hours of operation and that the Club plans no change in hours. Joseph Wojcik of 1 Main Street, Goshen will be the new President of the Northampton Revolver Club for 1995, and wanted to address some concerns of the Board. Wojcik noted that the new structure would be handicapped accessible, the building itself (the block) will be insulated, and acoustical tiles would be installed at an angle which would help decrease the noise level of the new range. Captain Joseph Koncas of the Northampton Police Department was present to support the Northampton Revolver Club's application. Koncas said that the Club had been very supportive to the Northampton Police Department and its needs in letting them use the range for fire arms training of its officers.
