Re: Wood Burning Plant at the Cooley Dickinson Hospital Date: November 19, 1980 You have asked me to review your opinion regarding the request of Mr. Fred MacInnis for a wood burning plant at Cooley Dickinson Hospital. You are correct in stating that such a proposed use comes under Article IX, Section 9.2 of the Zoning Ordinance. Under this section, the provisions of the Zoning Ordinance do not apply to prior non-conforming uses where there is no change in the use of an existing structure or no substantial extension of the existing structure. The adding of a 5,200 square foot wood burning boiler as a replacement for the previous heating mechanism is not a new use that is different in quality from the prior use. Further, the amount of additional footage when compared to the 265,000 square feet of the hospital itself, is not a substan- tial extension to the structure. As you have noted, the plant must meet the necessary requirements of the State Building Code as well as applicable environmental standards.
