Dear Mr. Welch:
The Board is in receipt of your letter dated August 9, 2006 and after reviewing it has determined that your
interpretation of 521 CMR Section 23.8 is incorrect. The Cooley Dickinson Hospital is open 24 hours a day 7
days a week while the valet service is only available from 6 a.m. to 6 p.m. In order for the facility to properly
comply with 521 CMR Section 23.8 Valet Parking and the relief from Sections 23.2 and 23.4.7 the Valet service
would have to be available at all times that facility is open.
The number of parking spaces as outlined in your letter has a total of 843 parking spaces which includes 434
employee parking spaces. This brings the total number of public parking spaces to 409. 521 CMR Section
23.2.4a requires outpatient units and facilities to provide 10%of the total number of parking spaces provided to
serve each such outpatient unit or facility shall be accessible. This requires forty-one(41) handicapped parking
spaces be provided. Six (6) of the forty-one (41)handicapped parking spaces are required to be van accessible
(521 CMR Section 23.2.2)
Please provide a written plan as to when the parking will be brought into compliance with 521 CMR Section 23
in its entirety or submit an application for variance within fourteen(14) days of receipt of this letter.

Dear Mr. Welch:
I am writing you today in response to your letter of October 16, 2006 in which you propose to provide 33
handicapped parking spaces at the above referenced facility,in addition to the valet service already provided
from 6 a.m. to 6 p.m.
As I wrote in my letter of September 26, 2006, because the Cooley Dickinson Hospital is an outpatient facility,
and the valet service is not available at all hours that the facility is open, technically 10%of the total number of
parking spaces available to the public must be handicapped parking spaces. As there are 409 public spaces at
the facility, 41 handicapped parking spaces are required.
If you wish to provide less than the 41 required handicapped parking spaces, you must seek a variance from the
Architectural Access Board for relief from 521 CMR 23.2.4a. For your convenience I am enclosing an
application form as well as a brochure describing the variance process. The Board requests within fourteen(14)
days of receipt of this letter you submit into our office either an application for variance or a plan for
compliance and date by which compliance will be achieved.

construction equipment scaffolding and other related materials which have displaced much of the designated and

displacement of parking highlighted by the introduction of valet parking at the main entrance to the hospital
designated and drop off areas Cooley Dickinson will bring its parking lots into full compliance with all relevant

displacement of parking highlighted by the introduction of valet parking at the main entrance to the hospital
designated and drop off areas. Cooley Dickinson will bring its parking lots into full compliance with all relevant

1. A request for a variance was filed with the Board by Norm Welch, CHFM, (Applicant) on December 11, 2006 .
The applicant has requested variances from the following sections of the 06 Rules and Regulations of the Board:

23.2.4a The requirement that Hospitals provide 10% percent of the public parking that is available as handicapped
parking in accordance with 521 CMR Parking and Passenger Loading Zones Section 23 et seq. Applicant is
requesting a time variance due to ongoing construction to provide 41 handicapped parking spaces by April 1,
2. The application was heard by the Board as an incoming case on Wednesday, January 3, 2007
3. After reviewing all materials submitted to the Board, the Board voted as follows:
GRANT: the time variance to Section 24.2.4a that allows the petitioner to move handicapped parking as needed until
April 1, 2007 at which time fully compliant handicapped must be provided in accordance with 521 CMR Section 23. The
Boards requires that a stamped site plan prepared by a licensed engineer be provided upon receipt of this notice
showing how the 41 handicapped parking spaces will be configured over the site.
Any person aggrieved by the above decision may request an adjudicatory hearing before the Board within 30 days of
receipt of_this decision by filing the attached request for an adjudicatory hearing. If after 30 days, a request for an
adjudicatory hearing is not received, the above decision becomes a final decision and the appeal process is through
Superior Court.

Per the receipt of your letter dated 05/24/07, Cooley Dickinson Hospital was bound to complete
the work of installing the required handicapped parking space signage, in accordance with
Section 23.6 of 521 CMR, in our Parking Lots "H" and "A", by the agreed upon due date of
07/01/07. Please find the enclosed prints showing that those signs, as of 06/26/07, have been
installed.
As a companion set of prints to the ones that were previously forwarded to your office showing
the locations of our handicapped parking spaces, you will see by these prints that every space is
clearly marked with its own sign per the requirements of 521 CMR. The prints are divided into
two sets, the first set showing the 4 sections of our Parking Lot "A" (21 total spaces), including
one additional print that highlights, by way of white arrows, the signs that may have been
difficult to see in the attached master print. The second set of prints shows our Parking Lot "H"
(20 total spaces), with corresponding reverse views of each row of spaces and additional prints
that highlight, again by the use of white arrows, signs that may have been hard to see in the
attached master print.
I would like to submit to your office the enclosed prints that demonstrate Cooley Dickinson
Hospital's compliance to your department's request and to the requirements of Section 23.6 of

Dear Mr. Wilson;
I am in receipt of your letter dated 06/29/07. As you have requested, I have measured
those concerns and find that the height of the signs, as installed, is 7ft 41n to the top of the sign.
This height measurement falls within the prescribed parameters of 521 CMR 23.6.4- "at a height
of not less than five feet, nor more than eight feet, to the top of the sign".
However, the distance of the installed signs indicated in your notated print that was sent
back with your letter, measures 12ft 15in. from their designated spaces, placing this outside of the
requirements listed in 521 CMR 23.6.1- "...no more than 10 feet away". This situation affects 6
of the 10 signs that are on that side of the parking lot due to the fact that the sidewalk is much
wider (1 lft wide) in that area than it is further down (5ft 2in wide), and so the posts had to be set
back, which is why they are not in line with the other four in that row. The sign posts in question
are currently driven into the lawn at the edge of the sidewalk and in order for them to be within
the required distance they will have to be relocated by driving them directly into the concrete
sidewalk, or into the asphalt itself, directly at the edge of the parking space bumper.
This poses two distinct problems for us- the first is, if we relocate the post into the
concrete sidewalk, than we run the risk of possibly impeding pedestrian traffic flow along that
part of the sidewalk and the second is, if we drive the post into the parking lot asphalt, measuring
1 ft 9in from the sidewalk's edge to the edge of the bumper, than we run the risk of there not
being enough clearance/ overhang past the bumper and having the pole damaged by an oversized
1.1 vehicle like a large SUV or truck trying to park there, and thus possibly damaging that vehicle in
turn.
Therefore, at this time, Cooley Dickinson Hospital is seeking a variance on 521 CMR
23.6.1 for the six handicapped parking signs located along the sidewalk of the North Building,
Parking Lot"H". Please find the enclosed photographic evidence showing the measurements of
the height of the handicapped parking signs and their relative distance from the parking spaces,
as well additional prints showing the linear arrangement of the signs and the sidewalk they run
parallel to.

1. An application for variance was filed with the Board by Norm Welch, CHFM, (Applicant)on December 11, 2006
The applicant has requested variances from the following sections of the20 06 Rules and Regulations of the Board:
Section: Description:
23.2.4a The requirement that Hospitals provide 10% percent of the public parking that is available as handicapped
parking in accordance with 521 CMR Parking and Passenger Loading Zones Section 23 et seq. Applicant is
requesting a time variance due to ongoing construction to provide 41 handicapped parking spaces by April
1, 2007.
23.6.1 On July 3, 2007 the original applicant for variance Docket#06-180 submitted a letter to the Board seeking
an additional variance regarding 521 CMR Section 23.6.1 for six handicapped parking spaces that have
signs installed at the head of each space that are located approximatley eleven (11') feet away from the
space in violation of the ten (10') foot maximum requirement set forth in 521 CMR Section 23.6.1.
2. The decision was reviewed by the Board on Monday, July 23, 2007
3. After reviewing all materials submitted to the Board, the Board voted as follows:
GRANT: the time variance to Section 24.2.4a that allows the petitioner to move handicapped parking as needed until April 1,2007 at
which time fully compliant handicapped must be provided in accordance with 521 CMR Section 23.The Boards requires that a stamped
site plan prepared by a licensed engineer be provided upon receipt of this notice showing how the 41 handicapped
parking spaces will be configured over the site.(This Decision was issued on January 3,2007)

The Main Entrance is used primarily for patients that need Laboratory, Cardiology and
Radiology services, and also serves as the visitor access to the Child Birth Center and the
Radiology
inpatient Medical/Surgical units. The Emergency Department entrance is an accessible entrance
with an accessible drop off area which provides access to Rehabilitation Services, Day Surgery,
Endoscopy, and Oncology and as well as serving as the visitor access to the inpatient Joint
Center.
Parking lot"F" (10 spaces) is used for company vehicles and parking lot "G" (20 spaces) is a
designated Doctors parking area.. Parking lots"C", "D" "E", "F "J" and "K" are used primarily
for first shift employees and ride-share parking and comprise 434 parking spaces combined.
From the furthest point out in these lots to the employee entrance is about one quarter of a mile.
Given the added distance and the difficult topography to the Main or Emergency Department
entrances from these lots, it is not reasonable to assume any of these spaces are acceptable for
Outpatient services use.
it is our belief that at this time there is only one parking lot ("N') with reasonable Outpatient
services access. We believe that given the number of spaces in that lot and the availability of the
Valet parking service, we have adequate handicap parking for Outpatient services patients. Our
daily Valet service parking numbers indicate that this is a constantly and regularly used service
by our patients and visitors alike. When the new building's parking lot opens we will identify
additional accessible spaces. However, at present, with only 182 spaces available in parking lot
"A" for regular and accessible Outpatient services parking, to take 10% of the present combined
total of 843 spaces, or 84 spaces, from this one lot creates an imbalanced parking condition_ The
lack of parking spaces for regular and accessible parking, during construction, has been well met
by the use of the Valet parking service. Our interpretation of section 23.8 is that the free Valet
parking service and accessible drop off areas presently satisfy the requirements of section 23.2
and 23.4.7.

Dear Mr. LeBlanc-
1 am in receipt of your letter dated July 26, 2006 that suggests Cooley Dickinson Hospital is in
violation of handicap parking regulation M.G. L. c 22,13A. This letter serves to communicate the
hospital's reasoning as to why we believe we are not in violation of this statute.
Enclosed is a copy of the current parking lot locations and the number of parking spaces in each
lot. The only lot that is located close enough to service our Outpatient units is parking lot "A". In
that lot there are 1.82 parking spaces, of which there are (10) ten handicap van spaces located
closest to the building entrances. In the rear of the building, at the NMI Outpatient entrance,
there is an additional designated handicap parking space.
The total number of combined spaces for the campus is presently 843 located in ten different
lots. Within this complement there are 227 spaces designated for specific use, or gated access,
for outpatient services which is accessible only for such patients. There are 434 spaces in distant
lots designated as employee parking. The remaining 182 spaces are represented in patient and
visitor parking lot "A". When the construction to the new building is completed, there will be an
additional 110 spaces located close to the entrance of the new wing. Designated spaces for
handicap parking for this new lot will be in compliance with M.G. L. c 22,13A. and 521 CNIR
23.1.
The hospital recognizes that during the two years of construction, parking for our patients and
visitors is at best difficult. To compensate for the long distances from the available parking lots
extra steps have been taken to make access easier. Valet service parking is provided from six
a.m. to six p.m. at the Emergency Department and the Main Entrance. Parking lots"B-1" and
"B-2" are gated lots that serve as the designated Valet service parking. This service is available
for all handicap vehicles. As described in section 521 CMR 23.8, a passenger loading zone is
provided that is compliant with 521 CNIR 23.7. On an average day, the Valet service will park
between 75 and 100 cars.

Upon information received by the Architectural Access Board, the facility referenced above has been reported to violate
M.G.L. c. 22, § 13A and the Rules and Regulations (CMR 521) promulgated thereunder. Reported violations, include the
following items:

23.2.4a Medical Facilities: Outpatient units and facilities: 10% of the total number of parking spaces provided to
serve each such outpatient unit or facility shall be accessible.
The complainant reports that there are a total of 1000 parking spaces provided with only 12 handicapped
parking spaces provided.
Under Massachusetts law, the Board is authorized to take legal action against violators of it's regulations, including but
not limited to, an application for a court order preventing the further use of an offending facility. The Board also has the
authority to impose fines of up to$1,000.00 per day, per violation,for willful noncompliance with its regulations.
You are requested to notify this Board, in writing, of the steps you have taken or plan to take to comply with the current
regulations. Please note the current sections may be different from the sections that are cited above. Unless the Board
receives such notification within 14 days of receipt of this letter, it will take necessary legal action to enforce its
regulations as set forth above. If you have any questions, you may contact this office.
