We have reviewed the plan and are returning same to the Mayor for dis- position. Following is a summary of the situation as I see it. The building permit was properly issued under the old zoning ordinance on July 18, 1975. Under Massachusetts General Laws, Chapter 40A, Section 11, however, no work performed under a building permit issued fa ter the Planning Board first advertised its hearing and before the ordinance is adopted may violate the new ordinance. It should be pointed out that there have been several court casee .clrrifying Section 11, including one (Inspec- tor of Buildings vs. Murphy) which found that the issuance of a building permit did not legalize a violation of the zoning ordi- nance. It appears to me that the first step which needs to be taken to 'r. bring the situation into compliance is to have the applicant file a request for a special permit to allow the gasoline station and a request for a variance (the lot is smaller then- required by the zoning ordinance) .
