Based on the estimated cost of construction versus the value of the building, the new work will have to be in full compliance with the requirements for new construction for a transient lodging facility. Paragraph 8.5.2 of 521 CMR states that"An elevator is not required in a transient lodging facility that is less than three stories or that has less than 3,000 square feet per story, if all rooms are proportionally distributed in accordance with 521 CMR 8.4.1 and all public spaces are fully accessible". The conclusions of the attached review comply with this criteria and therefore the renovation of this building as an annex to the Northampton Hotel facility does not require barrier free access to the second floor to meet the intent of the Code.
