32C-244 (4) Karen Hebert 59 Conz Street Northampton, MA 01060 586-4874 January 17, 2003 Tony, The "Right of Way" between 102-106 Hawley (Paul Hebert's property) and 112 - 116 Hawley Street (Andy Kaufman's property) was always open and is used by 10 other families besides Andy Kaufman and his tenants. Andy decided to fence off his property where his tenant's parked off street to make patios and now is parking 5 cars down one side of the "right of way". Jennifer Douillard (one of the tenant's) claims it is there land and they will continue to park. Andy Kaufman told Paul to stop plowing the "right of way". Unfortunately we had to hire Attorney Sean O'Leary who searched the deed's to make sure it is a "right of way" and not a "private way". Sean also stated it is illegal to park or block a "right of way" especially for fire/safety reasons. All four abutting properties have the "right of way" in their deeds. Sean will copy you as others the letter he is in the process of sending to Andy. Going to court is a long process but felt the city should be aware of the fact that one property owner has fenced off his parking area and is now using half of the "right of way" for a parking lot. List below are the tenant's that are parking on the "right of way" and not able to reason with. I'm not sure but think the owner Andy is also employed as a firefighter 112 Hawley - Andy Kaufman (owner) 114 Hawley - Mike Bellington - Westfield Paramedic Jennifer Douillard - Westfield firefighter/paramedic Stephen King - Eric Runstrom - Steve Sling - Westfield Firefighter We also contracted with Ernie's Towing to start monitoring Paul's parking lot on a regular basics and start towing any vehicles in his parking lot not belonging to his tenant's. As you know, he owns the property just to the North of yours. It has become apparent that you, or your tenants, by parking for extended periods of time in the right-of-way that separates your properties, are impeding the traffic to the rear of your property which is owned by my client and others. The client and others are the beneficiaries of this right-of-way which has been carried through in the deeds since the late eighteen hundreds. Impeding the right-of-way by blocking of traffic is not allowed by law, especially complete blocking of emergency equipment as would have been the case after the last snow storm. I strongly suggest that this should not happen again. I understand that there was parking previously for your tenants in the rear of your building, but since the rear is now fenced off, this is no longer possible. I further suggest that you provide off street parking in the rear as you did prior as city ordinance requires. I further understand that the client has advised you by signs or otherwise of these concerns. The recourse he will be left with if the conditions persist will be to have the vehicles towed at the owners' expense.
