3.0 RESULTS AND FINDINGS
The results of this inspection are presented in tabular form. These tables summarize the nature,
distribution, and quantity of ACM found during this survey.
Types, locations, quantities, and conditions of ACM are shown on Table 3.1. Suspect materials sampled
and found not to contain ACM are found in Table 3.2.

2.0 METHODS AND MATERIALS
2.1 ASBESTOS
Samples were collected in a statistically random manner using the Asbestos Hazard Emergency Response
Act (AHERA) protocol (40CFR763.86). Samples were placed into plastic bags with an air tight seal.
Labels were affixed to the sample bags with specific nomenclature. Sample number syntax rules assign
two character prefix related to the site name followed by an ascending chronological value. Material
location, estimated quantity, and physical assessment were recorded on field sheets included in Appendix
A.
Bulk samples were analyzed by Polarized Light Microscopy (PLM) using the United States
Environmental Protection Agency USEPA/600/R-93/116 method. The analysis of samples was
conducted by ProScience Analytical Services, Inc., 22 Cummings Park, Woburn, Massachusetts (NVLAP
Accreditation 2000090-0).
There are six minerals grouped into the term "asbestos." Chrysotile, amosite, and crocidolite are the
asbestos minerals most commonly found in building materials. ACM is defined as a material containing
more than one percent (1%) asbestos by weight. Materials found to be asbestos containing are listed in
Section 3.0. Exact sample compositions are included in the laboratory reports-or chains of custody found
in Appendix A.
Polarized light microscopy (PLM) is the root method used for the identification of ACM. The USEPA
Office of Research and Development (USEPA/ORD) has reviewed data from performance audits of
various laboratories performing PLM. The results of that review indicated an unacceptable number of
false negatives and positives for visual estimation of materials containing less than 10% asbestos. On the
basis of those findings the National Emissions Standards Hazardous Air Pollutants (NESHAP)
regulations were amended on November 20, 1990 (Federal Register, V.55, N.224). The revisions state
that if the analyst detects asbestos in the sample and estimates the amount to be less than 10% by visual
estimation, the parties legally responsible (owner or operator) for the building may(1) elect to assume the
amount to be greater than 1% and treat the material as ACM or (2) require verification of the amount by
point counting. Point counting is a technique used to quantify the amount of asbestos present in a sample
on which PLM has already been performed. ECS recommends point counting re-analysis for asbestos
values less than 10%, and where applicable those results are reflected in the report. In instances where
client authorization is not received for this reanalysis, PLM visual results indicating a trace or 1% value
will be reported as assumed ACM as required by item(1) above.
A similar situation exists for matrix bound fibers such as those found in floor tiles, mastics, and asphalt
based materials. The inorganic matrix of these bulk samples may interfere with the identification and
quantification of asbestos mineral content. These types of samples are generally referred to as Non-
organically bound (NOB) materials. Transmission Electron Microscopy (TEM-NOB) is a method that
utilizes a combination of special sample preparation techniques and high magnification to more
accurately quantify asbestos content. Currently only the State of New York has regulations requiring
TEM-NOB re-analysis of suspect ACM for which negative or trace determination resulted from PLM
analysis.

1.0 INTRODUCTION
This survey was done at the request of Mr. Rich Rivet of All American Fire Restoration, for the purpose
of identifying ACM that may impact future demolition of the residential structure located at 67 Hawley
Street in Northampton, Massachusetts. The Occupational Safety and Health Administration (OSHA)
regulations (1926.1101) requires that building owners determine the presence and location of asbestos
materials, and convey that information to any individuals who will conduct work that may disturb ACM.
The Scope of Work included destructive sampling of suspect materials at this commercial structure.
1.1 LIMITATIONS
The term "non-destructive sampling method" refers to a method of collecting samples that does not
significantly impact interior or exterior finishes of the building. Evaluations for the presence of ACM are
therefore limited to those materials accessible by non-destructive sampling methods. ACM may therefore
be present in materials not accessible by this sampling methodology, and may be encountered during
renovation or demolition of the structure. The term "destructive sampling method" refers to the method
of collecting samples that would require destruction of various building surfaces (i.e. wall cavities, wood
flooring, plaster ceilings) for the purpose of locating hidden heating, plumbing, or other building
components that may contain ACM. Destructive methods are strongly recommended for facilities slated
for demolition.
Additional limitations may exist for both destructive and non-destructive sampling methods. Certain
portions of the building may be physically inaccessible, or because electrical, mechanical, structural, or
other hazards exist in portions of the structure at the time of the survey.
The following areas were deemed inaccessible at the time of this survey:
• Below grade
• Electrical system
• Areas that have sustained fire damage and have compromised structural integrity

EXECUTIVE SUMMARY
Environmental Compliance Services, Inc. (ECS) has completed a survey for asbestos containing materials
(ACM) at 67 Hawley Street in Northampton, Massachusetts. On October 12, 2007 an ECS inspector
using destructive sampling methods, collected 24 samples of suspect asbestos materials. Those materials
have been analyzed using the required protocols at an accredited laboratory. A review of the laboratory
results indicates that ACM was detected at this location. Those materials which tested positive for
asbestos include:

18. Contractor's Default: If the Contractor shall fail to fulfill the Contractor's Agreement
herein, the Owner shall have all remedies available, both at law and in equity, to die Owner
under Massachusetts Law as a result thereof.
19. Acknowledgement: Owner acknowledges that the Owner has not been influenced to
enter into this transaction, nor has he relied upon any warranties or representations not set
forth or incorporated in this Agreement or previously made in writing.
20. Entire Agreement: This instrument, executed in multiple counterparts all of which
are deemed to be originals, is to be construed under the laws of Massachusetts and to take
cllect as a sealed instrument, and sets forth the entire Agreement between the parties. This
instrument is binding upon and inures to the benefit of the parties hereto and their
respective heirs, devisees, executors, administrators, successors and assigns, and may be
canceled, modified or amended only by a written instrument executed by the parties hereto
or their legal representatives.
21. Partial Invalidity: In the event that any clause or provision of this Agreement shall be
invalid or void for any reason, such invalid or void clause or provision shall not affect the
whole of this Agreement and the balance of tie provision tiereol' shall remain in full force
and effect.
22. Casualty/Loss: Contractor shall indemnify and hold harmless Owner for any loss or
damage Owner may sustain as a result of' injuries to Contractor's agents, employees,
subcontractors, or invitees or to any other third parties (unless caused by Owner) occurring
on the property during construction.

with certificates of such insurance prior to the commencement of
construction, and the Contractor shall be named as an additional insured.
16. Miscellaneous:
(g) The Contractor shall supervise and direct all work directed by this
Agreement, using its best skill and attention, and shall be solely responsible
For all construction means, methods, techniques, sequences, and procedures,
and for coordinating all portions of construction required under this
Agreement, and in accordance with all building and applicable Zoning Laws.
The Contractor shall be responsible for the work of all subcontractors.
(h) The Contractor shall provide and pay for all labor work, materials, tools,
equipment, machinery, water, heat, utilities, transportation, and other
facilities and services necessary for the proper execution and completion of
its obligations pursuant to this agreement.
(i) Unless otherwise agreed in writing by the Owner and the Contractor, the
Contractor shall pay all sales, use, and oilier similar taxes, which are legally
enacted anytime during this construction and for which the Contractor is
liable.
0) The Contractor shall give all notices and comply with all laws, ordinances,
rules, regulations, and lawful orders of any public authority bearing on the
subject construction.
(k) The Contractor agrees to secure and pay for all permits and inspections
required for the subject construction, including a final inspection for the
same.
(1) The Contractor will collect all written warranties and equipment manuals and
deliver them to die Owner on or before the Completion Date.
(m) Changes in the plans and/or specifications to subject construction shall be
accomplished after execution of- this agreement without invalidating this
agreement by written change order, which is agreed to by the Owner and the
Contractor in writing. Changes in said plans or specifications which are
agreed to in writing by the Owner and the Contractor shall be performed
pursuant to this agreement unless otherwise provided in a change order. All
change orders will describe the change in the work, state the amount of any
adjustment in the contract sum and/or contract time, and shall be signed by
the Contractor and the Owner.
(n) The Contractor represents that all mechanical components will be new and
first quality unless otherwise stated in Schedule "A" and shall be in good
operating condition upon completion of the terms of this Agreement.
17. Owner's Default: Should the Owner fail to complete all of the terms of this AgTeement
applicable to Owner and fail to pay the charges as required herein, the Contractor shall
retain all rights and remedies, both at law and in equity, and the Contractor shall be entitled
to retain all funds paid to the Contractor by the Owner. Retention of such funds shall in no
way prejudice other rights or remedies of the Contractor, either at law or in equity.

However, the Contractor does not guarantee against damage clue to normal or natural wear
and tear, nor conditions which arc the result of characteristics common to materials used or
to be expected of them, nor conditions resulting from condensation, expansion, or
contraction of materials, settlement, loss or injury caused in any way by the climate, or
damage caused by neglect by the occupants.
11. Clean Up: The home and work site will be delivered to the Owner in a clean
condition described as follows: Tree of' rubbish, bricks, lumber, cutoffs, and other
miscellaneous building waste, inasmuch as the same are present as the result of the
construction referenced in this Agreement. The interior of the home and other effected
areas of tlic dwelling will be broom clean, the windows will be washed, and any lighting or
plumbing fixtures will be free of labels and generally in a clean condition.
12. Construction of Agreement: Tlus Agrecmciit has been executed in one or more
counterparts and each executed copy shall be deemed to be an original, is to be construed
under the laws of Massachusetts, is to take effect as a sealed instrument, sets forth the entire
agreement between the parties, is binding upon and inures to the bcnclit of the parties
hereto and their respective heirs, devisees, executors, administrators, successors and assigns
and may be canceled, modified or amended only by a written instrument executed by the
parties hereto or their legal representatives. If two or more persons are named herein as
Contractor or Owner,their obligations hereunder shall be joint and several.
13. Notice: Any notice required to be given in this Agreement shall be in writing and
shall be deemed to be duly given when delivered to the party entitled to such notice at their
address as set forth herein by any of the following means: regular mail, postage prepaid, by
in-hand delivery, or by a nationally recognized overnight courier.
14. Other Conditions: See Schedule "A" (Plans and Specifications) and Schedule "B"
(Progress Report Breakdown) attached hereto and made a part hereof.
15. Insurance:
(a) 'hhe Contractor shall purchase and mountain insurance to protect it from
claims under workman's compensation acts and other employee benefit acts,
claims for daniages because of bodily injury, including death, and from claims
for damages other than to the work itself, to property which may arise out of
or result from the Contractor's operations under this Agreement, whether
such operations be by the Contractor itself or by any subcontractors or
anyone directly or indirectly employed by any of thein, with limits of'
$2,000,000.00 aggregate and $1,000,000.00 per occurrence as to liability and
property damage, and $100,000.00 as to worker's compensation. 'fhe
Contractor will provide the Owner with certificates of insurance for worker's
compensation coverage and liability coverage in the above limits prior to the
commencement of construction and the Owner shall be nanied as an
additional insured.
(b) The Owner shall maintain in force liability, property, and Builder's Risk
insurance during construction. The dwelling shall be insured in the full
value from loss or damage by fire. The Owner shall provide the Contractor

pursuant to this Agreement acid Owner terminates this Agreement, all deposits and other
funds paid by Owner to Contractor shall be refunded to the Owner forthwith.
4. Changes: Owner may request the right to order work changes in the nature of
additions, deletions or modifications to the Plans and Specifications without invalidation of
this Agreement. All changes will be authorized by a written change order signed by the
Owner and Contractor and shall be paid for at the time the Change Order is executed. All
credits will be totaled and credited to the Owner upon completion of the terms of this
Agreement.
5. Completion Date: Contractor agrees to complete the construction on spud premises,
as set forth herein, on or before (herein alter the "Completion Date"). However, the
Completion Date sliall be subject to weather conditions, abnormal conditions of' soil, or
other events beyond the Contractor's control. Contractor sliall not be liable for any losses
incurred by Owner as a result of delays in the Completion date for any of the reasons set
forth herein. Completion Date contemplates a start of' construction during the week of'
November 21, 2007. 'phis construction timeline begins after installation of any foundation
has been completed.
6. Delays: Contractor shall notify Owner within thirty (30) days of said Completion
Date of any events which may delay the completion of the terms of this Agreement, unless
such event was unforeseeable and occurs less than thirty days before Completion Date. In
such instance, Contractor shall notify Owner immediately of such delay.
7. Selections: Contractor sliall not be responsible for its inability to obtain Owner's
color selections of carpeting, siding, tile, bathroom fixtures, or other materials set forth on
the specifications. Substitute materials may be used upon written agreement of the Owner
and Contractor. The Contractor shall immediately advise Owner in writing ol'any changes
to the purchase price as a result of the substitute material. With written approval of the
Owner, the Contractor has the right to substitute materials of equal quality, should delivery
of material delay the construction schedule.
8. Subcontractors: Contractor sliall select and use subcontractors, employees, and
suppliers at its sole discretion, and sliall perform and schedule work in whatever way it
chooses. Unless specifically mentioned or shown on the contract documents, Contractor
reserves the right to substitute materials of equal quality, with the approval of the Owner, for
any materials herein specified in order to expedite delivery or completion ol'this Agreement.
Owner agrees that neither they nor anyone under their discretion will direct, order, or in any
way interfere with the Contractor or any of its subcontractors, employees, or suppliers.
9. Incomplete Work: Contractor warrants that the work will be substantially complete
on the Completion Dale. In the event, however, that any work is incomplete or items
require repair on the Completion Dale, Owner shall accept Contractor's written guarantee
that said work will be completed within a reasonable time.
10. Warranty: The Contractor warrants that the premises will be free from defects in
workmanship and materials for a period of one (1) year from the Completion Date.

Residential Construction Contractor Agreement
This agreement, made this __18th____ day of October, 2007, by and between All American
Fire Restoration, a Massachusetts Limited I-lability Corporation having a usual place of
business at P.O. Box 208, Chicopee, Massachusetts 01021 (hereinafter referred to as the
"Contractor") and Amy Semedian, having an address of 56 Williams Street, Northampton,
Massachusetts 01060 (hereinafter referred to as "Owner").
In consideration of the mutual promises and agreements hereinafter contained, Contractor
and Owner hereto mutually agree as follows:
1. General Scope: Contractor agrees to construct in a good and workmanlike manner a
New residential Home as per supplied print at 67 Hawley Street Northampton owned by the
Owner in accordance with the contracted documents between die parties consisting of:
(a) This Agreement;
(b) The Plans and Specifications signed by die parties and attached hereto as
Schedule "A" and made a part hereof, ad
