- ZONING BOARD OF APPEALS
At a meeting held on May 7, -'1986, the Zoning Board of Appeals of
the City of Northampton voted unanimously to grant the Finding request of
Mary Elizabeth Beach for the purpose of constructing a deck onto her
nonconforming structure located at 5 Kary Street, Northampton (URC Zone).
Present and voting were: Chairman Robert C. Buscher, William Brandt and t.
Sanford Weil, Jr.
The findings were as follows:
W. Brandt, referring to Section 9.3 of the Northampton Zoning
Ordinance, found that the addition of a 12 x 12' deck onto this
nonconforming structure will not be substantially more detrimental
- than the existing structure.
S. Weil concurred.
R. Buscher found that the addition of a deck onto the back of
the structure will not adversely affect the n .ghborhood•and will
not be substantially more detrimental than a fisting structure.

Pursuant to the provisions of the General Laws of the Commonwealth of
Massachusetts, Chapter 40A, Section 15, notice is hereby given that a decision
of the Board of Appeals of the City of Northampton was filed in the Office of
the City Clerk on May 23, 1986 granting a Special Permit Finding to Mary Elizabeth
Beach for property located at 5 Kary Street, Northampton, Hampshire County,
Massachusetts.
Pursuant to the provisions of the General Laws of the Commonwealth of
Massachusetts, Chapter 40A, Section 17, if you wish to appeal this action, your
appeal must be filed in Superior Court within twenty days of the date the
decision was filed in the City Clerk's Office.

The Board of Appeals also calls to the attention of the owner or applicant that General Laws,
Chapter 40A, Section 11 (last paragraph) provides that no variance or special permit, or any ex-
tension, modification or renewal thereof, shall take effect until a copy of the decision bearing the
certification of the town or city clerk that twenty days have elapsed after the decision has been
filed in the office of the city or town clerk and no appeal has been filed or that, if such appeal has
been filed, that it has been dismissed or denied, is recorded in the registry of deeds for the county
and district in which the land is located and indexed in the grantor index under the name of the
owner of record or is recorded and noted on the owner's certificate of title. The fee for such recor-
ding or registering shall be paid by the owner or applicant.
