Officer Date Northampton Zoning Board of Appeals Public Hearing on Application of Mary Elizabeth Beach May 7, 1986 The Northampton Zoning Board of Appeals held a public hearing on May 7, 1986 in Council Chambers, Wallace J. Puchalski Municipal Building to consider the request of Mary Elizabeth Beach for a Finding under the provisions of Section 9.3, Page 9.1 of the Northampton Zoning Ordinance for the purpose of constructing a deck onto her Nonconforming structure located at 5 Kary Street, Northampton (URC zone). Present were: Chairman Robert C. Buscher, William Brandt and Sanford Weil, Jr. The Chairman read the public notice as it appeared in the Daily Hampshire Gazette on April 23 and 30, 1986. He read Section 9.3 (A.1.) and reviewed Section 10.10 of the Northampton Zoning Ordiance. He advised those present of their right to appeal. The Chairman read correspondence from L. Smith, Planner, on behalf of the Northampton Planning Board recommending in favor of the petition. Mary Elizabeth Beach stated that she wishes to erect a 12 x 12' deck onto her pre-existing nonconforming structure, stressing that the requested use will not be of detriment to the neighborhood. She stated that there have been no objections from any of her neighbors, all of whom have been notified of her plans. Responding to an inquiry from S. Weil, Ms. Beach stated that the deck will be raised approximately 23" to the level of the door. R. Buscher expressed concerns with noise and questioned Ms. Beach regarding the distance to abutting properties. Ms. Beach explained that she is the only adult living in the dwelling and stressed that she would add latticwork around the deck for additional buffer. It was moved, seconded and voted unanimously to close the public hearing at 8:28 p.m. Referring to Section 9.3, W. Brandt found that the addition of a 12 x 12' deck onto this nonconforming structure will not be substantially more detrimental than the existing structure. S. Weil concurred. R. Buscher found that the addition of a deck onto the back of the structure will not adversely affect the neighborhood and will not be substantially more detrimental than the existing structure. Present and voting were: Chairman Robert C. Buscher, William Brandt and Sanford Weil, Jr. The findings were as follows: W. Brandt, referring to Section 9.3 of the Northampton Zoning Ordinance, found that the addition of a 12 x 12' deck onto this nonconforming structure will not be substantially more detrimental - than the existing structure. S. Weil concurred. R. Buscher found that the addition of a deck onto the back of the structure will not adversely affect the neighborhood-and will not be substantially more detrimental than e isting structure.
