32C-179 (33) Pursuant to Massachusetts General Laws (MGL), Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to pick up the certified decision from the City Clerk and record it at the Registry of Deeds. The Northampton Planning Board hereby certifies that a Site Plan Approval Permit has been GRANTED and that copies of this decision and all plans referred to in it have been filed with the Planning Board and the City Clerk. The requested use protects adjoining premises from seriously detrimental uses because the requested use is for a general office building, and professional and business offices are allowed in a GB zoning district. The applicant has made adequate provisions for drainage and for preserving sight lines onto Pleasant Street, as depicted on plans and information submitted to the Office of Planning&Development. Also, redevelopment of the site will eliminate a vacant lot. B. The requested use promotes the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets and will minimize traffic impacts on streets and roads in the area. The applicant has located parking spaces so that they will be visible from Pleasant Street, so turning movements into the driveway will be minimized since drivers will be able to see from the street if the parking spaces are full. Also, the parking spaces have been located to the front of the property, minimizing the traffic coming down the length of the driveway. C. The requested use promotes a harmonious relationship with existing structures and the existing landscape. D. The requested use will not overload the City's resources, including the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools. E. The requested use meets all special regulations set forth in the Zoning Ordinance. F. In addition, the Planning Board found that the applicant complied with the following technical performance standards:. A. Curb cuts onto streets are minimized because no new curb cut is proposed. B. Pedestrian, bicycle and vehicular traffic movement on site are separated to the extent possible. The following conditions were imposed upon the project: 1. The applicant must submit a revised site plan to the Office of Planning & development showing that the location of the parking spaces meets the requirements of zoning. 2. The applicant must submit to the Office of Planning & Development a lease or contract showing that he has obtained four additional parking spaces that will be used for his business and a plan showing the location of the leased spaces. This lease or contract or a similar agreement for at least four parking spaces must remain in full force and effect as long as the lot is used for any office use. Any spaces leased must be within a thousand feet of the subject property. 3.
