Harley Sacks,Esq. sai a home,located in Leeds,was one of the oldest ' orthampton,built in 1758. He said the home there before the road,and,in fact,it was t location of the road that was now an issue. Sacks sai a one thing the house lacked was expansive kitchen, and the bathroom was a little tight,and t owners were attempting to r edy that situation. The front of the existing structure is too close tot oad,and,therefore,t structure itself is nonconforming in that it violates the setback from the stree about a foot a half,he explained. Sacks noted that this was the only zoning violation,and he s ed that addition would not increase the violation. Sacks clarified that the sole decision of the Boar whether the addition would be substantially more detrimental to the neighborhood. He s mitted t since the house was set oft'from other properties,with a tennis court between it adjacent prope ,there was really no substantive issue that he could imagine. NeJame asked if the two stakes ' the ground were the comers [of t roposed addition]? The applicant said yes. NeJame noted that th epartment of Public Works(DPW)had no concerns. Members ask uestions to clarify the information that had been presented. The appl' t confirmed that the addition would be two stories, consisting of a.kitchen and bat 3 Bennett invited Herold to explain that he was going to raise the roof. In response,Herold approached the Board to point out features of the site plan. He confirmed that the roof was being reconfigured somewhat but that the footprint would remain the same. Brandt asked questions to determine the structure's proximity to the building next door,and the applicants confirmed that the structure would be very close to the property line and as close as five feet to the adjacent building. However,Krupczynski pointed out that Herold's first floor was about three or four feet higher [than the adjacent building's], so the windows were not at the same level. The existing structure also had windows,he noted. Kr.tpczynski clarified that the space would be used for commercial purposes,not residential. Herold said the space would be used as some sort of office or other[commercial]use. Narkewicz asked if the applicants had spoken to the VA(the owner of an adjacent building)about the proposal? Herold said he had spoken to Charlie Lyons of the VA,and he was fine with it. Members questioned whether the change from storage space to an office would be a change in use? Herold said he didn't consider it to be so. Knipczynski pointed out that the main building already had office use in the basement and on the first floor. Bennett commented that office space was an allowed use in the Central Business(CB)district. Bennett quoted Section 9.3 of the Zoning Ordinance as authority for the fact that pre-existing nonconforming structures could be changed if the alteration was not substantially more detrimental to the neighborhood. Snyder confirmed that the applicants were not creating any more of a nonconformity;they were only going up eighteen inches. Herold pointed out that the existing structure was "slightly distressed," having one wall that was severely buckled. According to the architects,the building was not structurally sound,he said. He noted that the garage was also screened by a mature row of arbor vitae which would be maintained. The reconstruction would be an aesthetic improvement,he asserted. Herold advised members that the initial use of the building would be for an artist's studio. He said he was assuming the new space could be used for the same range of uses currently allowed in the building. Brandt asked if an artist's studio was an allowed use? Bennett said he didn't know if this use was specifically defined per se.
