I visited your property on Friday, May 5, 2006. There is still an unregistered vehicle in your side yard, visible from the street. It was there last fall, and has not been moved. The City of Northampton Zoning Ordinances limit the number of unregistered vehicles allowed on residential property, define the difference between unregistered and junk vehicles and describe the requirements for storing unregistered vehicles that are permitted. Only two unregistered vehicles, and no junk vehicles, are allowed per parcel of land in the city, and the allowed vehicles "shall be screened from the view of the public and from abutting public ways and from abutting properties by being enclosed within a structure or sight impervious fencing or screening". It would appear that you are in violation of these zoning ordinances. I have included relevant excerpts from the zoning ordinances for reference. Please make arrangements to have the vehicle in question screened or removed in the immediate future, and contact me to discuss your plans. Unless you contact this office by 4:30 pm on Monday, May 15, 2006, 1 will issue a Notice of Violation of City Ordinances. Penalties for violations of city ordinances may, upon conviction, be affixed in an amount not to exceed one hundred dollars ($100.00) for each offense. MOTOR VEHICLE: Any vehicle self propelled by a battery powered, electric or internal combustion engine, which are permitted and requires a valid registration legally issued by a governmental authority in order to be operated on a public way. A motor vehicle shall include, but not be limited to automobiles, trucks, buses, motor-homes, motorized campers, motorcycles, motor scooters, tractors. The City of Northampton has zoning ordinances regulating unregistered and "junk" vehicles in residential areas. It seems that you are not complying with these regulations. The zoning ordinances allow no more than two unregistered vehicles on a residential property, and do not allow "junk" vehicles or parts. The same ordinances require that any unregistered vehicles that are allowed must be screened from view. The current City of Northampton Zoning Ordinance was adopted in 1975. The sections regulating unregistered vehicles were amended in October 2004. These regulations are intended to preserve the residential character of city neighborhoods, to eliminate the risks to children posed by these attractive nuisances and to prevent the environmental contamination that results from leaks and corrosion. Cars contain significant amounts of toxic materials, including sulfuric acid (corrosive and a poison), brake fluid (poison), antifreeze (a sweet-tasting poison that looks like a sports drink), gasoline, oils, asbestos and heavy metals such as lead, cadmium, chromium, copper and mercury. The normal processes of freezing, thawing and rusting will inevitably result in these substances leaking onto the ground and entering the water supply. An attractive nuisance is any hazardous object or condition that is likely to attract children, who are unable to appreciate the risks posed by the object or condition. This definition has been applied to abandoned cars, large appliances and unguarded swimming pools. Children often incorporate these cars in their play, and have been injured and even died of suffocation while playing in them. An abandoned car can pose as much risk as an unsecured refrigerator or freezer with the door still attached. It is easy to get rid of an unwanted or abandoned vehicle. Several of our local towing companies have volunteered to remove unwanted cars and trucks at no cost, even if the title is not available. Contact Florence Towing, 1812 Auto Body, Ernie's Towing, Cahillane Auto Body or the building department for more information. Improper storage of an unregistered or junk motor vehicle on your property is a violation of the zoning ordinance that can result in fines up to $300.00 per day. I will check back in a few weeks and if the vehicles are still present, I will proceed to the next step in the enforcement process. There is an unregistered motorcycle with no front wheel in your side yard, visible from the street. There is also a pickup truck in the front yard, along with the sedan that has been there for several years. Additionally, there is at least one vehicle behind the fence. The City of Northampton Zoning Ordinances (§350-8.8 (L&M) limit the number of unregistered vehicles allowed on residential property, define the difference between unregistered and junk vehicles and describe the requirements for storing unregistered vehicles that are permitted. Only two unregistered vehicles, and no junk vehicles, are allowed per parcel of land in the city, and the allowed vehicles "shall be screened from the view of the public and from abutting public ways and from abutting properties by being enclosed within a structure or sight impervious fencing or screening". It would appear that you are in violation of these zoning ordinances again.
