Dear Christopher and Susan,
I am following up on a complaint we received last September about unregistered
vehicles on your property.
I visited your property on Friday, May 5, 2006. There is still an unregistered
vehicle in your side yard, visible from the street. It was there last fall, and has not been
moved.
The City of Northampton Zoning Ordinances limit the number of unregistered
vehicles allowed on residential property, define the difference between unregistered and
junk vehicles and describe the requirements for storing unregistered vehicles that are
permitted. Only two unregistered vehicles, and no junk vehicles, are allowed per parcel
of land in the city, and the allowed vehicles "shall be screened from the view of the
public and from abutting public ways and from abutting properties by being enclosed
within a structure or sight impervious fencing or screening".
It would appear that you are in violation of these zoning ordinances. I have
included relevant excerpts from the zoning ordinances for reference.
Please make arrangements to have the vehicle in question screened or removed
in the immediate future, and contact me to discuss your plans. Unless you contact this
office by 4:30 pm on Monday, May 15, 2006, 1 will issue a Notice of Violation of City
Ordinances. Penalties for violations of city ordinances may, upon conviction, be affixed
in an amount not to exceed one hundred dollars ($100.00) for each offense. Each day,
or portion of a day, that any violation is allowed to continue shall constitute a separate
offense.

Chapter 350, Sections pertaining to unregistered and junk motor vehicles
Chapter 350 Section 2.0: DEFINITIONS
JUNK MOTOR VEHICLE: Any motor vehicle not capable of being used as such in its existing
condition by reason of being damaged or dismantled or failing to contain parts necessary for
operation and otherwise qualifying as junk.
MOTOR VEHICLE: Any vehicle self propelled by a battery powered, electric or internal
combustion engine, which are permitted and requires a valid registration legally issued by a
governmental authority in order to be operated on a public way. A motor vehicle shall include, but
not be limited to automobiles, trucks, buses, motor-homes, motorized campers, motorcycles, motor
scooters, tractors.
MOTOR VEHICLE ACCESSORIES: Any part or parts of any motor vehicle.
UNREGISTERED MOTOR VEHICLE: Any motor vehicle required to be registered by law of
the Commonwealth of Massachusetts for operation on public ways, not so registered.
Chapter 350 Section 8.8 Parking and Loading Space Standards.
All parking and loading areas shall comply with the following:
J. Except on a farm, not more than one commercial vehicle, and said vehicle shall not
exceed a weight of 10,000 pounds gross weight shall be garaged or in any way stored on any
lot in any Residential (R) District.
L. No more than two (2) unregistered motor vehicles (any vehicle that does not have a valid
Registration legally issued by a governmental authority), and no motor vehicle
accessories which are not parts of said two vehicles, may be parked, stored or otherwise
placed on a parcel of land in the City of Northampton without a Special permit from the
Zoning Board of Appeals. This section shall not apply to the parking, storage or
otherwise placing of unregistered motor vehicles and/or motor vehicle accessories where
such parking, storage or placement is in connection with a legally established business
selling new and/or used automobiles and trucks, or automotive repair or automobile
service stations. This section shall also not apply to trucks and tractors which are in use
for bona-fide agricultural purposes.

Dear Property Owner or Tenant,
I've left this letter because there is at least one unregistered vehicle on your property that is
visible from the street. The City of Northampton has zoning ordinances regulating unregistered and
"junk" vehicles in residential areas. It seems that you are not complying with these regulations.
The zoning ordinances allow no more than two unregistered vehicles on a residential property,
and do not allow "junk" vehicles or parts. The same ordinances require that any unregistered vehicles
that are allowed must be screened from view.
The current City of Northampton Zoning Ordinance was adopted in 1975. The sections
regulating unregistered vehicles were amended in October 2004. These regulations are intended to
preserve the residential character of city neighborhoods, to eliminate the risks to children posed by
these attractive nuisances and to prevent the environmental contamination that results from leaks and
corrosion.
Cars contain significant amounts of toxic materials, including sulfuric acid (corrosive and a
poison), brake fluid (poison), antifreeze (a sweet-tasting poison that looks like a sports drink), gasoline,
oils, asbestos and heavy metals such as lead, cadmium, chromium, copper and mercury. The normal
processes of freezing, thawing and rusting will inevitably result in these substances leaking onto the
ground and entering the water supply.
An attractive nuisance is any hazardous object or condition that is likely to attract children, who
are unable to appreciate the risks posed by the object or condition. This definition has been applied to
abandoned cars, large appliances and unguarded swimming pools. Children often incorporate these
cars in their play, and have been injured and even died of suffocation while playing in them. An
abandoned car can pose as much risk as an unsecured refrigerator or freezer with the door still
attached.
It is easy to get rid of an unwanted or abandoned vehicle. Several of our local towing companies
have volunteered to remove unwanted cars and trucks at no cost, even if the title is not available.
Contact Florence Towing, 1812 Auto Body, Ernie's Towing, Cahillane Auto Body or the building
department for more information.
Improper storage of an unregistered or junk motor vehicle on your property is a violation of the
zoning ordinance that can result in fines up to $300.00 per day. I will check back in a few weeks and if
the vehicles are still present, I will proceed to the next step in the enforcement process. The next step is
a formal "Notice of Violation"; the final step before a fine.

In response to a complaint received on July 15,2002 I did a site visit. There are unregistered vehicles with
smashed windows and car parts visible to the public.
I have enclosed a copy of the Northampton Zoning Regulations section 8.9 paragraphs 12 and 13 pertaining
to unregistered vehicles and parts.
As this is the third time I have informed you of this situation it needs to be corrected within ten(10)days or
face possible fines of$100 per day.

I am following up on a complaint we received about unregistered vehicles on your property.
visited your property on Tuesday, May 29, 2007. There is an unregistered motorcycle with no
front wheel in your side yard, visible from the street. There is also a pickup truck in the front yard, along
with the sedan that has been there for several years. Additionally, there is at least one vehicle behind
the fence.
The City of Northampton Zoning Ordinances (§350-8.8 (L&M) limit the number of unregistered
vehicles allowed on residential property, define the difference between unregistered and junk vehicles
and describe the requirements for storing unregistered vehicles that are permitted. Only two
unregistered vehicles, and no junk vehicles, are allowed per parcel of land in the city, and the allowed
vehicles "shall be screened from the view of the public and from abutting public ways and from
abutting properties by being enclosed within a structure or sight impervious fencing or screening".
It would appear that you are in violation of these zoning ordinances again.
Please make arrangements to have vehicles removed within one week, and insure that the two
permitted vehicles are screened from view. Please contact me to discuss your plans. If you are not in
compliance with this zoning ordinance by Wednesday, June 6, 2007, 1 will issue a Notice of Violation of
City Ordinances. Penalties for violations of city ordinances may, upon conviction, be affixed in an
amount not to exceed one hundred dollars ($100.00)for each offense. Each day or portion of a day that
any violation is allowed to continue shall constitute a separate offense.
A number of towing companies have agreed to remove unregistered vehicles without charge. I
