Shimel, Chairman Northampton License Commission Northampton City Hall 240 Main Street Northampton, MA 01060 SUBJECT: Request for License Commission Hearing—Jaynie Corp.D/B/A Silent Cal's Dear Chairman Shimel: In response to a neighbor's complaint about loud music at Silent Cal's, your office requested that the police department keep an extra eye on that establishment. On November 5, 2003 at approximately 12:23 a.m., Officer Matthew J. Simpson, while on patrol on Pleasant Street, heard loud music coming from Silent Cal's. The volume of the music was so loud, that it could be heard across the street at Randolph Place. Upon entering the establishment the officer found that a DJ was playing music. The officer spoke with the manager about the loudness of the music, as well as the fact that their weekday entertainment license did not allow for the use of a DJ. At that time, the manager was given a warning by the officer. One week later, on November 12, 2003 at approximately 12:39 a.m., Officer Simpson and Officer Corey J. Robinson heard loud music coming from Silent Cal's. Again, the music was of such volume that it could be heard across the street at Randolph Place. Upon entering the establishment, the officers found a DJ performing and producing the loud music. The manager was informed of the violation and the music was shut down. It is requested that the License Commission conduct a hearing regarding: 1. Silent Cal's use of a DJ in violation of conditions of its weekly entertainment license (MGL, Chapter 140§182), and 2. Chapter 140 § 182 Weekday Entertainment License Dear Mr. Hebert: You are hereby notified that the Northampton License Commission will hold a hearing on Wednesday,December 3, 2003 at 5:00 p.m. in the City Council Chambers of the Wallace Puchalski Building,212 Main Street,Northampton,MA to determine if Jamie Corp d/b/a Silent Cal's Caf6 shall have its Weekday Entertainment License modified and/or not renewed. The Commission has received a report from the Northampton Police Department alleging that several incidents have occurred in which loud music was heard coming from your establishment. Upon further investigation,the Police Department determined that the loud music was generated by a D.J. and also that according to the conditions listed on your Weekday Entertainment license, the use of a D.J. is not an allowed use. You are entitled to be present at this hearing, to be represented by counsel, to present and cross- examine witnesses and to speak and offer evidence on your own behalf.
