32C-166 (18) Pursuant to Massachusetts General Laws (MGL) , Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to" pick up the certified decision from the City Clerk and record it at the Registry of Deeds. The Special Permit is contingent upon the applicant staying in compliance with the parking requirements of the Zoning Ordinance, and shall be tied to the continued use of the premises. 2. An executed renewal of the leased parking spaces shall be submitted to the Planning Department, to become part of the file, a minimum of 30 days prior to expiration of the existing lease. 3 . Signage shall be allowed in accordance with what is permittted withih the Zoning Ordinance. 4 . An executed lease, as discussed within the public hearing, must be submitted to the Planning Department, to become part of the file, prior to the issuance of an occupancy permit. 5. Conditions numbered 1 and 4, must be complied with prior to the issuance of the occupancy permit. C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area by having an existing parking lot be used by two facilities, reducing the need for additional pavement. D. The requested use will not overload, and does not require mitigation of any adverse impacts on, the City's resources. E. The permit is not required to meet any other special regulations set forth in the Zoning Ordinance. F. The requested use bears a positive relationship to the public convenience or welfare because it provides for employee parking in accordance with the Zoning Ordinance. G. If applicable, the requested use will promote City planning objectives to the extent possible and will not adversely affect those objectives, as defined in City master or study plans adopted under M.G.L. Chapter 41, Section 81-C and D. In reviewing the Site Plan, submitted with the :cial Permit, the Planning Board: 1. Lavelle, for a SPECIAL PERMIT with Site Plan Approval under the provisions of Section 8.7 in the Northampton Zoning Ordinance, to have a shared parking facility to provide parking at 196 Pleasant Street. Planning Board Members present and voting were: Chair Andrew Crystal, Vice Chair Daniel Yacuzzo, Mark NeJame, Jody Blatt, Nancy Duseau, Kenneth Jodrie, and Paul Diemand. In Granting the Special Permit with Site Plan Approval, the Planning Board found: A. The requested use for a shared parking facility protects adjoining premises against seriously detrimental uses, by providing for additional parking as required under the Zoning Ordinance. B. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area, by providing the necessary parking for employees, off-site on a neighboring parcel.
