Dear Ted:
Construction on the above property was begun in 1984. The area
was, at that time, zoned GB. Subsequently the area was rezoned
to URC. The property is a mixed residential/business use. In a
GB zone the use is allowed by right. There are, however, certain
restrictions on the type of business uses which are permitted in
the mixed use. These may include certain retail establishments,
personal and consumer service establishments, and professional
and business offices. In a URC zone,a mixed residential/business
use requires a special permit and the business uses are
restricted to miscellaneous professional offices only.
The property is now being used as a mixed use in accordance with
the GB zone definition. It is, therefore a pre-existing non-
conforming use in the URC district. One of the business units is
now vacant and a question has arisen as to what uses may
legitimately be established in that unit.
It is my opinion that any use that would be allowed in a mixed
residential/business use in a GB zone may be established on this
property. Such uses would be within the defined limits of the
pre-existing non-conforming use and would not be an expansion of
that use.
