SFence -2- If ij RAYMOND CAPERS, ACTING CHAIRMAN ol �� �� ARTHUR ZINKlN ROBERT BUSCHER I� DECISION OF THE (� ZONING BOARD OF APPEALS i u , {� I At its meeting on July 2, 1980, the Zoning Board of Appeals for the City of Northampton voted unanimously to grant the petition of Marvin and George ' Spence for a special permit to fill a parcel of land which abuts the Old Mill- River bed. k Based upon the evidence presented to the Board, the Board made the follow- :' ing findings in regard to the special permit: i , 1. The proposed use is listed in the Table of Use Regulations. k � 1 i 2. The proposed use bears a positive relationship to the public welfare in that it allows for the development of a previously undevelopable parcel of land. I 3. The proposed use will create some heavy traffic in the area, but only for a relatively short time. i :1 4. The proposed use will not cause the municipal systems to be j overloaded. f 5. The proposed use is in agreement with the general purpose of the Zoning Ordinance, in that it will enhance the area rather than impair its character or integrity. is I The special permit is, however, granted subject to the following condition$II : �I f iF 1. That the applicants comply with Section 11.3 in its entirety; l and 1 } 2. that Huntley Associates, the engineering firm overseeing the I project, submit certification of the exact number of cubic j yards of fill to be used; and t j I p rovides detailed information firm also (i 3. that the engineering in writing, on the temporary methods planned to prevent erosion I �! at the site during the filling; and j " 4. that a time schedule for the completion of the project be sub- I' mitted to the Board; and I� �i 5. that the applicants obtain some form of permission from Mrs. Wysacki and Mr. and Mrs. McHugh to fill their land as well, filling the land to grade so that drainage on their property will not be adversely affected; and i 6. that some form of ground cover, not necessarily landscaping, be provided immediately after the filling is completed.
