32C-163 (3) r `4 DECISION OF THE 1-3' ZONING BOARD OF APPEALS r At a public meeting, held in the Hearing Room, City Hall, on November 1 , 1979, the Zoning Board of Appeals decided to GRANT WITH CONDITION$ the August 30, 1979, request of Richard J. and Joan L. Shea for a variance to convert a 7-unit apartment building into 14 apartment units. Based on the evidence adduced at the hearing, held on October 3, 1979, the following findings were made: 1. In its present condition the building is deteriorated. 2. The building is unique in that its present division into seven large apartments render it uneconomic to improve. 3. The changes requested would take place within the existing struc- ture, thereby maintaining present open space. 4. Although the building is in a general business district, its present use is residential and it would be uneconomic to convert it to a business use. 5. The type of housing proposed for this lot is needed in the down- town area. 6. There should be at least one parking space for each apartment. 7. There should be a right-of-way over parcel 1 on the annexed plan in favor of parcel 2. 8. The long narrow configuration of this lot makes it unique and unlike any other lot in the same district. The members voted as follows: TO GRANT THE VARIANCES REQUESTED, SUBJECT TO CONDITIONS BELOW: Mr. Gervais, Mr. Brushway, and Mr. Buscher. TO DENY: None Conditions imposed: 1. That before commencing any construction, the applicant obtain all permits deemed necessary by the Conservation Commission. 2. That before commencing any construction, the applicant submit to the Board of Appeals documents confirming the right-of-way shown on the annexed plan. 3.
