Duggan November 1, 2005 Fire Chief Ye Old Watering Hole 287 Pleasant.Street Northampton, MA 01060 Dear Sir or Madam: As a result of the tragic nightclub fire in Warwick, Rhode Island, the Commonwealth of Massachusetts enacted Chapter 304 of the Acts of 2004, An Act Relative to Fire Safety in the Commonwealth. Section 5 of this new law added Massachusetts General Law c. 148, s. 26G 1/2 which requires every building or portion thereof of public assembly with a capacity of 100 persons or more that is designed or used for occupancy as a nightclub, dance hall, discotheque, bar or for similar entertainment purposes to be equipped with an adequate system of automatic sprinklers. Upon review it has been determined that the above-referenced establishment falls under the provisions of this new law. You are hereby ordered to comply with the provisions of the statute in accordance with the following schedule: 1. Plans and specifications for an adequate sprinkler system as required by statute shall be submitted to this office with a copy to the Building Inspector no later than May 15, 2006. 2. The sprinkler system must be completed no later than November 15, 2007. You are strongly urged to take appropriate action at this time in order to meet the compliance deadline of the new law. Under the provisions of M.G.L. c. 148, s. 26G %2, you have the right to appeal this order to the Commonwealth's Automatic Sprinkler Appeals Board, P.O. Box 1025, State Road, Stow, MA 01775 within 45 days after service of this letter. If you have any questions, please contact me. I represent the building owner, McCarthy Properties, Inc., landlord for Ye Olde Watering Hole, as their property manager and authorized agent. Thomas Douglas Architects was hired to inspect the location and did confirm a capacity over 100 occupants. Since both the landlord and the tenant, Ye Olde Watering Hole, feel the order to sprinkler the building would cause financial hardship to both parties, Thomas Douglas was asked to create a plan limiting the capacity to less than 100 occupants. That plan is enclosed. As both the landlord and the tenant agree the new plan suits the needs of both parties, a building permit was obtained to begin altering the space in accordance with the plan. I respectfully request that you review the enclosed materials and ask that you consider rescinding your order that the landlord install a sprinkler system throughout the building, subject to the completion of the permitted renovations.
