32C-144 (4) f DECISION OF THE f'IZONING BOARD OF APPEALS i At its meeting on November 17, 1980, the Zoning Board of Appeals for the j City of Northampton voted unanimously to grant the petition of Sheila Scanlon j for a special permit to use the former Para-Medic Ambulance Service building on Michelman Avenue as an automotive repair shop. The petition for a variance Eto use existing living quarters in the building was denied because the vote was! E not unanimous. i Based upon the evidence presented to the Board, the Board made the follow- ing findings in regard to the special permit: 1. The proposed use is listed in the Table of Use Regulations. E! ''. 2. The proposed use bears a positive relationship to the public f!j convenience because of a need for such a business. 3. The proposed use would not create traffic congestion nor im- pair pedestrian safety. 4. The proposed use will be less burdensome on the public utilities than the previous use. I j` 5. The proposed use would not impair the character and integrity t of the district as there were similar structures or uses in (j the general area. In regard to the variance, one member felt that the intent of the Zoning i Ordinance would be defeated by allowing a residential unit in such proximity to a repair shop with its inherent danger of fire and fumes, and that any hard ship would be eliminated by use of the building for car repairs. !' Since the Zoning Board of Appeals did not vote unanimously to grant the variance, the variance was denied. j .j Ij Tft0MAS BRUSHWAY, ACTING CHAT ~ RAYMOND CAPERS j i I j ARTHUR ZINKIN i i i! f I I i j i
