j I At a meeting held on September 17, 1986, the Zoning Board of
Appeals of the City of Northampton voted unanimously to grant the
Special Permit request of Michael Sissman, P.O. box 1096, Northampton,
z
MA, for the purpose of allowing construction of two buildings and
I three garages within one hundred feet of a Watershed Protection District i
at property located at Pleasant Street and hichelman Avenue, Northampton
(URC Zone). Present and voting were: Chairman Robert C. Buscher,
William Brandt and Peter Laband.
The findings were as follows:
! W. Brandt found that all requirements as set forth in Section 14.6
of the Northampton Zoning Ordinance have been met and that multi-
family dwellings are permitted in a URC zone as a matter of right.
P. Laband, referring to Section 10.10 specific to the two structures
located within the Watershed Overlay Protection District, found that
the use is listed in the Table of Use Regulations; that the requested
use bears a positive relationship to the public convenience; that
the requested use will not create undue traffic congestion; that
the requested use will not overload municipal systems; that Article
XI has been addressed under the Conservation Commission' s findings;
and that the requested use will not unduly impair the character
of the zone. and is in harmony with the ordinance. He also found that
the conditions of Section 14.6 have been met.
R. Buscher found that although the development will result in
traffic problems on Michelman Avenue and Pleasant Street, this
issue is not relevant to what the applicant is requesting under
Section 14. 6, as the applicant could construct the development '
by right (without the two structures located in the Watershed
Overlay Protection District) and these two separate issues (traffic i
I! and Watershed District) cannot be conjoined. He stated that as i
the Conservation Commission has acted favorably upon this request,
and the Planning Board finds no planning issues, and as the applicant'
has met all of the conditions of Section 14.6, he would vote in favor;
I� of the petition.
The Board mandated that all of the requirements of Section 14.6 1
of the Northampton Zoning Ordinance, as well as the Conservation
Commission' s Order of Conditions become a part of this Special Permit.

tension, modification or renewal thereof, shall take effect until a copy of the decision bearing the
certification of the town or city clerk that twenty days have elapsed after the decision has been
filed in the office of the city or town clerk and no appeal has been filed or that, if such appeal has
been filed, that it has been dismissed or denied, is recorded in the registry of deeds for the county
and district in which the land is located and indexed in the grantor index under the name of the
owner of record or is recorded and noted on the owner's certificate of title. The fee for such recor-
ding or registering shall be paid by the owner or applicant. `
