ASSESSOR'S MAP and PARCEL NUMBERS: MAP: 24C PARCEL: 158
At a meeting conducted on April 12, 2001, the Zoning Board of Appeals authorized Zoning
Administrator, granted the request of Cathy Hunter for a FINDING under Sections 6.2 & 9:3
(1)(D) in the Northampton Zoning Ordinance to rebuild and renovate a 22' by 24' section of
the house for property located at 28 Arlington Street, Map 24C, Parcel 158.
Zoning Administrator: Bob Riddle.
The Findings of the Zoning Administrator under Section 9.3 (1)(D) for a change of a pre-
existing nonconforming structure were as follows:
1. The Zoning Administrator found that the change (rebuild and renovate a 22' by 24'
section of the house) would not be substantially more detrimental to the neighborhood
than the existing nonconforming structure and would not extend any closer to any front,
side, or rear property boundary than the current zoning allows or existing structure
already extends, and would not create any new violation of other zoning provisions; and
does not involve a sign.

Dear Ms. Duseau:

OFFICE OF PLANNING
& DEVELOPMENT
My wife and I are scheduled to appear before the planning
board on August 24. We are hoping to add a deck to our 120 year
old house at 28 Arlington St. Our hearing is for a finding "to
remain out of code," if I have the terminology correct. Since
our house was built within fifteen feet of the side boundary
before building codes were invented a finding is necessary in
order to get permission to build t e deck straight out the back
of the house.
I am writing because there is a chance that neither my wife
nor I will be able to attend the Meeting. I am a filmmaker, a
founder of Florentine Films, working'on a freelance basis. I am
afraid this means that when I get work, I cannot control the
schedule.
On the evening of August 24th I will actually be filming in
Belchertown as part of a shooting ,schedule that includes Ohio,
New Jersey and the Pioneer Valley. x hope to be able to arrive
at the meeting by its end, but will not be able to arrive before
8:30.
Due to a family crisis, my wife will be forced to leave
Northampton during that period and will be unable to attend the
meeting as well.
We understand that our assigned time to appear before the
Planning Board cannot be changed. , I am writing to explain our
absence to you and the other members of the Planning Board and to
ask that you not rule against us for our inability to attend.
For the three months we have been waiting to get the necessary
approvals from the City, we have had every intention of doing
attending.
As for the reasons our deck should
to respectfully say the following:
1. This is the only place the deck
to the allowable distance from the side
in front of the house, whereas making
too small for the planned carport.
2. We will conform to the lines

Dear Mr. Smith:
July 14, 1989
Thank you for allowing us to amend our application
from a Variance to a Finding for "a pre- existing non-
conforming structure." I imagine that when we first went
to the Building Inspector's office to determine which
type of permit was necessary for the construction of a
deck /car port that the Finding was overlooked.
With you approval and a letter from Bruce Palmer,
the Clerk's office agreed to keep our August 24th hearing
date thus allowing us to amend the application without
going through the process from the beginning.
Thank you again for your assistance.
