As stated on the application "Clients are requested to contact the Housing Rehabilitation Coordinator with any questions pertaining to the work under contract. No calls should be made by the client directly to the con- tractor unless specified. " I have been in touch with Paul McCutcheon and the city building inspectors in regard to the above and I trust that you will abide by this request. Because the water table on your property is so high, work on the deck cannot be continued at this time. That is the decision of both the contractor and the building in- spector. It will be the decision of the contractor when the time is right for completion. Any work done without our approval will not be warrantied. It is the understanding of the Home Repair Program that an agreement has been reached between the City's Building Inspector and Paul McCutcheon, the contractor, is as follows: Unless it is otherwise determined prior to work commencing, the present builder's tubes measuring approximately 8" diameter by 48" depth will be replaced by builder's tubes measuring 12"X48" to provide extra footing, if deemed necessary,due to soil conditions on the construction site. Please accept this letter as notice that the contractor for the work performed at our home has not satisfactorily completed his work under the contract. The work that remains to be completed is as follows: 1. The Building Inspectors Office has refused to issue a Certificate of Occupancy because (a) the deck has not been anchored in compliance with the Building Code; (b) the first step is too high from ground level. 2. The contract called for the basement wall to be back- filled with gravel. The material that was used for back- filling was sand which is unstable. 3. The filled area has not been properly graded and surface water runs to, rather than away from the house. We expect that the work to be performed under the contract will be completed in a proper manner. It is not our intent that our repayment of our obligation to the City of Northampton will relieve the city or the contractor of their obligations under the contract, including completion of the work in a workmanlike manner. We request that the city will not issue final payment until the work has been satisfactorily completed and the warranty required in the contract is delivered by the contractor.
