At this point I don't feel comfortable signing this letter. I am not disputing the survey done in the year 1969 but as of now we don't have any property pins to accurately say where the boundary line is. On December 11,2005 Shirley,Dave,Carol,Brian and I sat down and discussed the issue. We have all agreed that we are going to work this out between the families. I spoke with Carol and Dave December 12,2005 and they told me they were going to have the property surveyed so we can have property pins to go by. Mrs. Laizer supplied our office with a surveyed plot plan of existing conditions done by Harold Eaton and associates on April 20, 2006. The surveyed plan shows the newly constructed garage being 10.41 feet from lot line and the furthest point. A building permit application was applied for and approved for you on May 23, 2003 to build a attached garage. The information that you supplied showed that garage was 17' from property line and was approved based on your information. The zoning requirements for URA/WSP require a 15' side set back,which your documentation said you had. The surveyed plan also shows that the lot line abutting your neighbor is not perpendicular to rear lot line as your plan showed but is at a diagonal which further reduces the side set back on garage and also places the swimming pool, which was installed without permits, on your neighbors property. The allegations are serious. A variance would be needed to build the attached garage if the surveyed plan supplied by your neighbors is correct. You have thirty days from receipt of this letter to provide a stamped survey plan shown-th at the information you provided for the building permit(BP-2003-1019)to construct the attached garage is accurate and setbacks do comply with Northampton Zoning. Failure to produce this documentation will result in court action to have structures removed. A building permit is required for the swimming pool that you installed. The application for that swimming pool must also have a surveyed plot plan showing the location of the swimming pool on your property. The site inspection that I trade with your permission showed that the gate and latch are not code compliant and posses a serious risk of un- authorized entry to swimming pool by children and must be corrected immediately.
