The failure to grant a finding could lead to a vacant building in an area where occupancy is important for safety. In an economic downturn, the zoning laws should accommodate a reasonable business proposal which will be beneficial and not detrimental to the neighborhood. 2 Exhibit A Application For Zoning Permit For a Finding For Service Properties, Inc. 82 Conz Street, Northampton, MA The current uses are nonconforming. The building on the property is approximately 28, 000 square feet and has been leased by New England Telephone for many years for a variety of uses. The current uses include a repair, dispatching and maintenance facility for commercial vehicles, offices and conference center, a computer and telephone repair center, and associated parking and garage. There are approximately 70 vehicles and 80-90 employees that use the facility. These current uses are nonconforming in some respects in a special industrial (SI) zone. "Commercial motor vehicle maintenance, garaging and parking facilities" (p.5-6) is permitted only by special permit in the SI zone. Business service and repair service establishments are also permitted only by special permit in the SI zone (p.5-5) . Business offices are not permitted in the SI zone (p.5-5) . The present uses would not be permitted by right, predate existing special permit requirements, and are therefore nonconforming. The proposed use would be beneficial to the neighborhood. The owner has negotiated a lease, subject to obtaining zoning permission, with an existing Hampshire County business that is not willing to be identified until a finding is authorized. The tenant seeks to rent about 20, 000 square feet of the 28, 000 square foot building. The proposed tenant's business is the wholesale distribution of knitting and yarn supplies, related offices, and small accessory retail space of about 2 ,200 square feet. The proposed tenant will not relocate without the small retail area, although it is a minor aspect of the business. The project involves no change in the building footprint but requires interior and facade renovations to accommodate the new use. The principal use is "wholesale trade and distribution, " which is allowed by right in the SI zone (p. 5-6) . The applicant seeks a "finding" that the proposed accessory retail use would not be substantially more detrimental to the neighborhood than existing nonconforming uses under Section 9. 3 . A yarn supply distribution business would replace the current heavy equipment, maintenance, and repair activities. This change would greatly reduce vehicular traffic. It is expected that the yarn supply business will involve parking by about twelve employees, a daily U.P.S. van pickup, a once-a-week truck delivery, and incidental retail traffic.
