The issuing authority hereby orders the following (check all that apply):
® The property owner, his agents, permittees, and all others shall immediately cease and desist
from the further activity affecting the Buffer Zone and/or wetland resource areas on this property.
❑ Wetland alterations resulting from said activity should be corrected and the site returned to its
original condition.
® Complete the attached Notice of Intent. The completed application and plans for all proposed
work as required by the Act and Regulations shall be filed with the Issuing Authority on or before
March 21, 2002 for an April 11 hearing or earlier.

No further work shall be performed until a public hearing has been held and an Order of
Conditions has been issued to regulate said work.
IN The property owner shall take the following action to prevent further violations of the Act:
Filing requires surveyed wetland delineation and identification of possible floodplain. Contact
Conservation Commission agent upon receipt of this notice indicating intentions and timeline.
for meeting this Order. If the applicant does not contact Commission by January 24, owner maY
be subject to fines of up to$100 for each day of the violation, beginning on the day of this notice.
Failure to comply with this Order may constitute grounds for additional legal action. Massachusetts
General Laws Chapter 131, Section 40 provides: "Whoever violates any provision of this section (a)
shall be punished by a fine of not more than twenty-five thousand dollars or by imprisonment for not
more than two years, or both, such fine and imprisonment; or(b) shall be subject to a civil penalty not
to exceed twenty-five thousand dollars for each violation". Each day or portion thereof of continuing
violation shall constitute a separate offense.
D. Appeals/Sig- natures
An Enforcement Order issued by a Conservation Commission cannot be appealed to the Department of
Environmental Protection, but may be filed in Superior Court.

Dear Mr. Thompson,
Our office received a copy of an Enforcement order from the Northampton Conservation
Commission that was issued to you on January 16, 2002, for the erection of a new
building without Conservation Commission permits. I checked our files and found no
record of a building permit for the project. 780 CMR section 110 of the state building code
requires that you file an application for a building permit., you have failed to do. Please
contact this office and apply for the building permit, failure on you part to do so will
result in additional fines and or court action.
