DECISION OF THE
ZONING BOARD OF APPEALS
The Zoning Board of Appeals for the City of Northampton met on December
L30. 1981 and voted unanimously to grant the petition of Michael Karakula for
1 a variance to add a second apartment to his single family home at 26 Smith.
h Street.
" Based on the evidence presented to the Board, the Board made the follow-
1 ing findings in regard to the variance.
1. That the property in question is unique in that the home is
one of few remaining single family dwellings in the area and
is situated on a lot which is larger than some of those con-
taining multi-family dwellings.
2. The property is located in a transitional zone, with many
commercial properties in the general vicinity.
ii3. A literal enforcement of the zoning ordinance would create a
hardship for the petitioner, who is now retired and would
have difficulty maintaining a large home if he were prevented
from using his property to generate additional income.
4. The proposed use would not derogate from the intent of the
Zoning Ordinance because it would add housing to the City,
and therefore, would be in the public interest.
1 The variance is however, granted subject to the condition that the apart-
ment meet the standards of the Massachusetts Building Code.
