11 The Zoning Board of Appeals for the City of Northampton met on December
i 30, 1981 and voted unanimously to grant the petition of Michael Karakula for
1,11 a variance to add a second apartment to his single family home at 26 Smith
Street.

jl Based on the evidence presented to the Board, the Board made the follow- .
1 ing findings in regard to the variance.

1. That the property in question is unique in that the home is
one of few remaining single family dwellings in the area and
is situated on a lot which is larger than some of those con-
taining multi-family dwellings.

2. The property is located in a transitional zone, with many
commercial properties in the general vicinity.
'1 3. A literal enforcement of the zoning ordinance would create a
hardship for the petitioner, who is now retired and would
1 have difficulty maintaining a large home if he were prevented
from using his property to generate additional income.

4. The proposed use would not derogate from the intent of the
Zoning Ordinance because it would add housing to the City,
and therefore, would be in the public interest.
The variance is however, granted subject to the condition that the apart-
ment meet the standards of the Massachusetts Building Code.

December 30, 1981
The Board of Appeals held a public hearing at 7:00 PM, December
30, 1981, on the petition of Michael Karakula for a variance to add a
second apartment to his single family home at 26 Smith Street.
Present were Chairman Robert C. Buscher, Peter Sharac, and Peter Laband.
The Chairman read the public notice as it appeared in the Daily
Hampshire Gazette on December 16 and December 23; the Planning Board's
recommendation of approval; and a memo from Lawrence Smith, Senior
Planner, which noted the requirements for a variance.
He informed those present of their right of appeal of any decision
handed down by the Board.
Michael Karakula, the applicant, told the Board that the home had
been purchased by his family in 1928 , at which time it was a two-family
home. As the family size increased, the house was used as a single-
family dwelling, although assessed as a two apartment home as recently
as 1967 . As a retiree living alone, Mr. Karakula said that he now
finds the house too large for him to maintain, and wishes to reconvert
it to a two-family home. Each of the two floors will contain a four
room apartment. A two-car garage, measuring 20 feet by 22 feet , and a
23-foot driveway will privide adequate parking for four cars. Each
apartment will have its own entrance , and a second stairway will be
added so that each unit will have two exits.
According to Mr, Karakula, the area is zoned URC, with two-family
homes allowed by right, but the lot, containing 9,360 square feet,
lacks the required 12,000 square feet required by the present zoning
ordinance. The neighborhood contains many multi-family homes and
businesses.
There was no one present to speak in favor or in opposition.
After discussion, the Board decided to proceed with the decision
on the matter.
The Chairman found that the property is unique, in that the home

and thus be in the public interest. He would vote to approve the
variance , with the restriction that the apartments meet the standards
of the Massachusetts Building Code.
Mr. Sharac and Dr. Laband agreed with these findings.
On a motion made and seconded, the Board then voted unanimously
