RE: Zoning Violation, Operation of sit down Restaurant in NB district where consumption of food and
drink is primarily on location without Special Permit from PB; 350-attacment 2 Northampton Zoning
Ordinances
Dear Mr. Cahillane,
Our office received a complaint (copy attached) that operations of the World War II Club are in violation
of Northampton Zoning Ordinances. Specifically section 350-5.2 Table of use regulations (copy
attached) requires restaurants and drinking places where consumption is primarily intended to be within
the building in NB district receive a Special Permit from the Planning Board. The World War II Club
does not have the required Special Permit from the Planning Board. The previous use as private club
was a pre-existing non-conforming use, that use has changed World War II Club is no longer a private
club as the general public is now allowed to enter and receive services.
You are required to apply to the Northampton Planning Board as per 350—5.2 for a Special Permit to
continue operations as a restaurant and drinking establishment in area zoned as NB. Failure to apply
for and receive the required special permit can result in fines of up to $100 per day for each day
violation continues and or actions which could result in a cease and desist order.
