Pursuant to Mass. General Laws, Chap. 40A, §11, no variance,
finding, or special permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed with the City Clerk and
that no appeal has been filed, or if such an appeal has been filed
that it has been dismissed or denied, is recorded in the "Hampshire
County Registry of Deeds or Land Court, as applicable" and indexed
under the name of the owner of record or is recorded and noted on
the owner' s certificate of title. The fee for such recording or
registering shall be paid by the owner or applicant. It is the
owner or applicant's responsibility to pick up the certified
decision from the City Clerk and record it at the Registry of
Deeds.

Conditions are as follows:
1. The applicant must meet the 30' setback requirement or the
applicant must come back to the ZBA for a variance if they
cannot meet the setback requirement.
2 . A sketch should be submitted showing appropriate shrubbery to
be planted around the hut. The Office of Planning and
Development shall review and approve the sketch and the plan
for landscaping and maintenance of the shrubbery.

At a meeting held on May 19, 1993, the Northampton Zoning
Board of Appeals voted unanimously to GRANT the request of New
England Telephone for a SPECIAL PERMIT under the Provisions of
§5.2 , page 5-3 of the Northampton Zoning Ordinance to construct a
small single story equipment building at #118 Florence Street for
a utility sub-station for fiber optic cable service. The Zoning
Board of Appeals voted unanimously to APPROVE the SITE PLAN REVIEW
under the Provisions of §10. 11 of the zoning ordinance. Present
and voting were Chairman Robert C. Buscher, William R. Brandt, and
M. Sanford Weil, Jr.
The findings were as follows:
1. The requested use is listed in the Table of Use regulations as
requiring a Special Permit in the district for which
application is made.
2 . The requested use bears a positive relationship to the public
convenience by adding modernized telephone service to the
area.
3 . The requested use will not create undue traffic congestion or
impair pedestrian safety.
4 . The requested use will no overload any public water, drainage
of sewer system.
5 . The requested use will not unduly impair the integrity of the
neighborhood or adjoining zones nor will it be detrimental to
the health, morale or general welfare.
6. The Zoning Board found that the applicant has met all the
criteria under §10. 11 for Site Plan Approval.
