The AAB regulations define public use (5.1 Definitions: PUBLIC USE: Describes interior or exterior rooms or spaces that are made available to the general public. Public use may be provided at a building or facility that is privately or publicly owned). If the use of a space changes from private to public (CHANGE OF USE: Varying the use of a building from a private use to one that is open to and used by the public), regulations require an accessible entrance, and an accessible route to the space: 3.4 Jurisdiction: CHANGE IN USE When the use of a building changes from a private use to one that is open to and used by the public, an accessible entrance must be provided, even if no work is being performed. When a portion of a building changes use from a private use to one that is open to and used by the public, then an accessible route must be provided from an accessible entrance even if no work is being performed. I'm pretty sure that there's an accessible entrance, but an accessible route to the basement space would require some sort of lift or elevator. If the basement has been used as public space, 521 CMR 3.4 would not apply. We would accept a a letter from the building owner or tenant. The first floor of the building (approximately 2600 ft.2)was renovated in 2008 for an Optometry Office. The second floor of the building contains separate offices. No construction was done on the second floor. The existing Ground Floor contains an older area with limited headroom, and a newer 600 ft.2 area with code compliant headroom. This latter portion is the area for the proposed Vision Batting Therapy.
