Dear Owners:
During a response to a fire at your property at 11 Conz Street it became obvious that the front
porch is in significant disrepair. It is also apparent that there has been work on an egress stairway .
servicing the 2nd and 3rd floors without permitting.
These exits are the primary egress for this structure and needs to be made safe immediately.
The structure is a 6 unit commercial building requiring control construction for any work completed.
The Massachusetts State Building Code, 780 CMR Chapter 1 requires that "All buildings and
structures and all parts thereof, both existing and new, and all systems and equipment therein which are
regulated by 780 CMR shall be maintained in a safe, operable and sanitary condition. All service
equipment, means of egress, devices and safeguards which are required by 780 CMR in a building or
structure, or which were required by a previous statute in a building or structure, when erected, altered or
repaired, shall be maintained in good working order."
Continued use without repairs constitutes a violation of the building code. This letter shall, in
accordance with section 116, serve as a notice of violation and order to make safe the required means
of egress. Penalties in accordance with section 116 will be assessed if the violations are not corrected.
You are hereby required to immediately install caution taping to restrict the use of the 1st floor
level porch to a section directly from the stair to the doors. You are further required to provide an initial
front porch report prepared by a registered design professional to evaluate the condition of the structure
no later than later than August 20, 2013. If you do not provided a satisfactory inspection report by that
time we will have no choice, but to post this structure unsafe to occupy and remove the tenants from
this property until such time an evaluation is completed and necessary repairs completed.
Our telephone number is 587-1240 and our office hours are Monday through Friday, 8:30 am to
4:30 pm, excepting that we close at 12:00 noon on Wednesdays. My email address is: cmiller
